Quick answer

Yes, a factory in Maharashtra needs a fire NOC: every industrial building in Schedule-I of the Maharashtra Fire Prevention and Life Safety Measures Act, 2006 needs a Provisional fire approval at plan stage and a Final approval before use, at any size; a low-hazard unit up to 2,000 m² and below 18 m may self-certify under MFS order 1763 of 10 December 2025.

Inside an MIDC industrial area, MIDC's own fire service issues it through the MIDC single window, in 30 days for the Provisional and 15 for the Final approval; inside a municipal corporation the city's Chief Fire Officer does; elsewhere the Director of Maharashtra Fire and Emergency Services, on the MFS E-Approval portal.

There is no renewal: a licensed agency's Form B every January and July keeps the approval alive. MIDC's Fire Protection Fund fee runs from Rs 1 to Rs 20 per m² of built-up area, by hazard, size and zone, with minimums from Rs 5,000.

How to get a fire NOC for a factory in Maharashtra

  1. Find your fire authority

MIDC plot: MIDC's fire service. Inside a municipal corporation: its Chief Fire Officer. Anywhere else: the Director of MFS.

  2. Classify the building

Fix the hazard class (G-1, G-2, G-3, storage or hazardous) and the built-up area and height of the largest building; a low-hazard unit up to 2,000 m² and below 18 m can take the self-certification route.

  3. Gather the process papers

Process flow chart, raw materials and finished goods with storage quantities, MPCB consent to establish, and explosives or petroleum approvals where they apply.

  4. File for Provisional approval with the plan

In MIDC the building plan, Provisional fire, water and drainage requests go together through BPAMS; the fire officer issues a demand letter for the Fire Protection Fund fee.

  5. Install through a licensed agency

Only an MFS-licensed agency may install and certify; its Form A goes with the Final approval application.

  6. Get Final approval, then file Form B

Final approval before use, then Form B every January and July for as long as the factory runs.

Maharashtra Factories Rules 1963: rule 70 and a factory's fire layout

Rule 70 is the factory-law fire rule a Maharashtra plant still works to while the state's OSH rules remain a draft.

Word for word

Every factory shall be provided with adequate means of protection and escape in case of fire.

Maharashtra Factories Rules, 1963, rule 70 (Fire Protection), as substituted on 10 August 1989 Indian Kanoonnews report

The rule goes on to ask for explosion and flash-fire processes in segregated buildings, fire-resisting walls round serious fire hazards, flame arresters, automatic extinguishers or fire dampers on risky ducts and conveyors, passages of at least 90 cm and 2 m clear above stored piles. The OSH Code keeps existing rules alive during the transition so far as they do not contradict it, and Maharashtra's 2026 draft OSH rules for factories were not final by 28 October 2026.

Maharashtra factory fire NOC worked cases: 4 MIDC plots

MIDC's fee rows applied to the sites the brief names. Our working from the published schedule; the demand letter decides.

  1. Case 1

    A 1,500 m² light-engineering unit, Zone B

Single-storey G-1 shed, 8 m high, on an MIDC plot.

What applies Rs 5 per m² gives Rs 7,500, below the Rs 15,000 minimum, so Rs 15,000. It is small enough for order 1763's self-certification route; whether MIDC applies that MFS order is not stated. MIDC

  2. Case 2

    A 6,000 m² warehouse, Zone A

    Single-storey storage building, 12 m high.

What applies Rs 7 per m² gives Rs 42,000, above the Rs 20,000 minimum, so Rs 42,000; then Form B each January and July. MIDC

  3. Case 3

    A 400 m² solvent store, Zone C

Single-storey hazardous building with flammable solvent drums.

What applies Rs 5 per m² gives Rs 2,000, so the Rs 15,000 minimum applies. The PESO licence must be attached to the Provisional application. MIDC

  4. Case 4

    A 10,000 m² chemical plant, Zone A

    High-hazard G-3 building, 14 m high.

What applies Rs 20 per m² gives Rs 2,00,000, above the Rs 1,50,000 minimum. At 10,000 m² it is a section 45 building: monitoring system and audit every 2 years. Amendment Act 2023

Where Maharashtra factory fire approvals stall, and the fix

Most MIDC fire files stall on the process papers or on the agency, not on the fee.

  • If No storage quantities on the block plan

Mark where each raw material and finished good sits and how much; MIDC lists it as the first pre-requisite. MIDC

  • If MPCB consent to establish not yet issued

Apply for it early: MIDC lists MPCB documents among the Provisional NOC papers. MIDC EoDB

  • If Plant redesigned after the Provisional NOC

Submit an as-built area statement and pay the differential fee before the Final application. MIDC EoDB

  • If Form B sent on paper to an MIDC fire station
