Fire NOC in Andaman and Nicobar: Today's FCC and Regulation 5 of 2026

Updated By Flamekite Editorial DeskFacts checked against official sources on

Quick answer

The Andaman and Nicobar fire clearance certificate lasts 1 year today. Regulation 5 of 2026 brings a 5-year certificate, but no start date by 24 October 2026. Until then the Chief Fire Officer in Port Blair issues a one-year Fire Clearance Certificate (FCC) for hotels, bars, hospitals, schools and 5 other kinds of premises, applied for on the Fire Service's online portal.

The new law is a President's regulation under article 240, published in the Gazette of India on 25 May 2026. Once the Administrator notifies its start, buildings over 15 m and hotels, resorts and other special buildings need a fire safety certificate valid 5 years, issued within 1 month, with a maintenance certificate every July. Its fees are left "as may be prescribed", and no rules had been found.

How to get a fire clearance certificate in Andaman and Nicobar, step by step

  1. Check which regime applies

Regulation 5 of 2026 starts only on the date the Administrator notifies. Until a notification is published, the Fire Service issues the 1-year FCC described on its portal.

  2. Match your premises to the list

The portal names 9 classes, from hotels and bars to schools, hospitals and fireworks sellers. Under the Regulation the line is a building over 15 m, or a hotel, resort, eating house or other special building, or a mixed occupancy over 500 m².

  3. Gather the 5 documents

The sketch map and Form F of the land, the approved building plan, the statutory business licence, the building and stability certificate, and the electrical wiring quality and completion certificate.

  4. Apply for a new FCC online

On the Fire Service Department's Online Service Portal, choose Apply for New FCC and fill the 19 items of the application: who you are, where the premises are, the survey number and the nature of the activity.

  5. Prepare for the inspection

A Fire Brigade Officer inspects before the certificate issues. The portal publishes the inspection schedule and result, and lists the checkpoints for each kind of premises.

  6. Download the certificate

The Chief Fire Officer's FCC grants no objection for 1 year, as long as nothing changes in the fire fighting arrangements. A copy goes to the Assistant Commissioner (HQ), South Andaman.

  7. Renew every year

Log in with the FCC's Dispatch No. and date to renew. Once Regulation 5 of 2026 starts, the certificate runs 5 years and a maintenance certificate falls due every July.

What section 26 of the Andaman and Nicobar Regulation says about the certificate

One sub-section sets the term, and it is the one most guides quote. It binds only once the Regulation starts.

Word for word

(4) Without prejudice to the existing Building bye-laws applicable and enforcement of bye-laws by the local authority, the owner or occupier, as the case may be, shall obtain "fire safety certificate" from the Fire and Emergency Service for the buildings mentioned in sub-section (2), which shall be valid for five years from the date of issue of such certificate.

Andaman and Nicobar Islands Fire and Emergency Service Regulation, 2026 (No. 5 of 2026), section 26(4) Gazette of India Extraordinary, Part II Section 1, No. 19, 25 May 2026

Section 26(6) adds the yearly duty: after the certificate, the owner or occupier files a certificate "once a year in the month of July" that the fire protection system is in good and efficient condition. Section 26(3) stops any authority from issuing an occupancy certificate until the fire and life safety approval of section 26(2) is in place. The 5 years run from the date of issue, not from the occupancy certificate.

Does your Andaman and Nicobar hotel, resort, homestay, bar or school need fire clearance?

Find the line that fits. Each answer gives today's FCC rule and, where it differs, what Regulation 5 of 2026 will require.

  1. If A hotel or resort on Swaraj Dweep (Havelock) or Shaheed Dweep (Neil)

Today: an FCC, since hotels are 1 of the portal's 9 classes. Under the Regulation: hotels and resorts are special buildings needing the 5-year certificate. Both islands have their own fire station. A&N Fire Service portal

  2. If A homestay or guest house

Neither the portal's 9 classes nor section 26 names a homestay. Whether a homestay counts as a hotel under s.26(2)(b)(i) is not settled; ask the Chief Fire Officer in writing. Gazette of India Extraordinary, Part II Section 1, No. 19, 25 May 2026

  3. If A bar or restaurant

An FCC for Bar and Restaurants, and the Deputy Commissioner's bar licence needs the Chief Fire Officer's verification, in 45 days under the 2018 draft charter. South Andaman DC charter

  4. If A school

An FCC. The portal's school checklist asks for enough exits, staircases at least 1.50 m wide, dedicated fire water tanks and 5 types of extinguisher. A&N Fire Service portal

  5. If A hospital, sanatorium or nursing home

An FCC, checked against the National Building Code: buildings of 15 m or more with over 500 m² a floor need 2 staircases of 2.0 m. A&N Fire Service portal

  6. If An apartment block

Not in today's 9 FCC classes. Under the Regulation, a block over 15 m, or an apartment building over 500 m² on all floors, needs plan-stage approval and the certificate. Gazette of India Extraordinary, Part II Section 1, No. 19, 25 May 2026

  7. If A diesel or petrol storage and sale point

An FCC for petroleum storage, and the Deputy Commissioner's licence (applied for on Form IX under the Petroleum Rules; the licence itself is Form XII or XIII) lists a NOC from the Fire Department among its documents. South Andaman DC charter

  8. If A pandal for a festival or wedding

Under the Regulation the erector is self-regulatory: display a declaration of fire measures; the Nominated Authority may inspect and remove a pandal that is not fixed in time. Do I need a fire NOC? Gazette of India Extraordinary, Part II Section 1, No. 19, 25 May 2026
