Quick answer

A fire NOC for a factory in Gujarat is not always required. Since the Second Amendment Rules of 8 July 2021, the fire safety certificate list (the Third Schedule) has no industrial line and covers only hazardous buildings not covered under the Factories Act, so a factory needs one when its building is 15 m or taller, and a godown with more than 500 m² on a floor or a hazardous store outside the Factories Act needs one at any height.

The certificate comes from one of Gujarat's 6 Regional Fire Officers, or the Chief Fire Officer inside the 8 municipal corporations, whether or not the plot is in a GIDC estate. You apply on GujFireSafety CoP or, as an investor, through the Investor Facilitation Portal, whose sheet promises 7 working days.

A fire NOC has not been a document for a Gujarat factory licence since the Labour Department's resolution of 9 February 2022. In July 2026 the state decided to hand factory fire NOCs to the Urban Development Department; no notification had been published by 28 October 2026.

How to get a fire NOC for a factory in Gujarat

  1. Test the building against the July 2021 list

Measure the height and the largest floor of each block. A block of 15 m or more, a godown with a floor over 500 m², or a hazardous store outside the Factories Act needs the certificate; a single-storey production shed below 15 m is not listed.

  2. File the factory side first

Seek plan approval in Form 31 under rule 69 of the Gujarat OSH Rules, 2025, with plans showing the means of escape, then apply for the licence in Form 33 under rule 75. Neither form asks for a fire NOC.

  3. Open the fire application

Register on GujFireSafety CoP, or create a project on the Investor Facilitation Portal and pick Fire NoC External. The application goes to the Regional Fire Officer or the corporation's Chief Fire Officer.

  4. Get the Fire Safety Plan Approval

Upload the fire plans for each listed block and pay the plan fee: Rs 2,500 for a ground-floor godown, Rs 5,000 for a single-storey hazardous store.

  5. Install, then apply for the certificate

Fit the systems the Regulations ask for, pay the per-m² certificate fee and allow the Fire Officer's site inspection. On the IFP route the certificate is generated after the final payment.

  6. Keep it alive

Diary the 3-year expiry, appoint an enrolled Fire Safety Officer before it, and file the declarations on time; late filings cost a share of the fee for each 90-day block.

What the Gujarat OSH Rules 2025 ask of a factory about fire

Gujarat's factory rules under the OSH Code, gazetted on 12 June 2025 in place of the 1963 rules, ask for escape routes on the plans and put common fire systems on the landlord, but list no fire NOC.

  1. 1. Rule 69: plan approval

No premises may be built, extended or used as a factory without the Chief Inspector-cum-Facilitator's prior written permission, sought in Form 31 with the process flow and raw materials with storage quantities. Gujarat Gazette

  2. 2. Form 31 plans

The enclosure list asks for plans showing "means of escape in case of fire", the plant layout, aisles and passages. Gujarat Gazette

  3. 3. Rule 75: the licence

Applied for in Form 33 and granted in Form 34; no fire NOC is among the papers. Gujarat Gazette

  4. 4. Rule 82: shared premises

Where separate buildings are leased as separate factories, the owner keeps the common fire prevention and protection system; in a flatted factory the owner answers as occupier for the fire system and its water. Gujarat Gazette

  5. 5. The 2020 to 2022 interlude

A fire NOC was a licence document only from 26 November 2020 until the resolution of 9 February 2022 dropped it. Gujarat Labour GR 2022

Gujarat fire NOC fees for factory godowns and hazardous stores

Annexure 8 of the Regulations 2023 has no manufacturing row. A factory pays only for its listed blocks, at the godown, hazardous-store or building-type rate; the IFP sheet prints the same amounts.

As published

Certificate fees are per m² of built-up area. Annexure 8 prices godowns from 250 m² while the Third Schedule lists storage from 500 m² on a floor; the Regulations do not explain the gap. Every state's rates are on the fire NOC fees page.

Where Gujarat factory fire approvals go wrong, and the fix

Most delays come from applying the wrong 2021 list, or from treating a campus as one building.

  • If A consultant files for a 600 m² production shed under the January 2021 moderate-hazard line

Cite the 8 July 2021 Third Schedule and ask the fire officer to record whether the block is listed. Gujarat Rules, Jul 2021

  • If The finished-goods godown on the campus is forgotten

Measure each floor: a godown floor over 500 m² is listed even if the production shed is not. Gujarat Rules, Jul 2021

  • If The IFP renewal fee and Annexure 8 differ

The IFP sheet states Rs 2,500 a block plus Rs 1,000; Annexure 8 a flat renewal fee. Ask which applies before paying. Gujarat IFP

  • If A 6-monthly declaration is missed after renewal

Each 90-day block of delay costs 100% of a fee; diary both dates. Gujarat Fire Safety Compliance Portal

  • If A buyer or insurer asks for a fire NOC the rules do not require

Keep the Third Schedule text and the 9 February 2022 resolution on file, and the NBC Table 7 systems note 3 advises. Gujarat Labour GR 2022

What Flamekite could not confirm about Gujarat factory fire NOCs

How fire officers apply item (a), the 15 m high-rise line, to registered factories. The text has no exception; we found no circular either way.

How the carve-out "not covered under The Factories Act, 1948" reads now that the OSH Code replaced that Act on 21 November 2025. No Gujarat notification updates the words.

Whether a godown inside a registered factory falls under item (b)(1) storage. Regulation 26(g) groups storage with hazardous buildings "not covered under the factory act 1948", but the Third Schedule's carve-out sits only on item 6.

Whether the Gujarat Pollution Control Board lists a fire NOC among the documents for consent to establish or consolidated consent. Its 2023 guidance manual has checklists, but we could not read them.

Any GIDC fire NOC procedure or fire service charge for a bare plot. GIDC's pages describe the fire NOC that comes with a plug-and-play shed and list fire stations among estate amenities, and nothing more.

The Urban Development Department notification reported on 20 July 2026, and the 2021 resolution said to have given factory fire safety to the Labour Department. Neither was found by 28 October 2026.

Questions about fire NOC for factories in Gujarat

Is fire NOC mandatory in Gujarat for a factory?

Only for some blocks. Since 8 July 2021 Gujarat's Third Schedule has no industrial line, so a factory needs a fire safety certificate for a block of 15 m or more, a godown with more than 500 m² on a floor, two basements, or a hall with more than 300 m² of assembly. Hazardous stores outside the Factories Act need one at any size.

Is a fire NOC required for a factory licence in Gujarat?

No. The Labour Department's resolution of 9 February 2022 cancelled the 2020 resolutions that had made a fire NOC part of the licence file, and the Gujarat OSH Rules, 2025 list none for plan approval (Form 31) or the licence (Form 33).

Who issues fire NOC in GIDC?

The same officers as anywhere in Gujarat: the Regional Fire Officer for the district, or the Chief Fire Officer inside one of the 8 municipal corporations. GIDC publishes no fire NOC role for its 239 functional estates or 23 notified areas, though its plug-and-play sheds come with a fire NOC for the whole structure.

Can a new MSME in Gujarat start before its fire NOC?

Gujarat's MSME Facilitation Act, 2019 lets a new unit run for 3 years on a declaration, with 6 months after that to obtain its approvals. The unit signs an undertaking to ensure adequate fire safety, and the Act waives no fire standard.

How to get a fire NOC for a factory in Gujarat?

Check each block against the July 2021 Third Schedule, then apply on GujFireSafety CoP or as Fire NoC External on the Investor Facilitation Portal. Get the plan approval, install the systems, pay the per-m² fee and pass the fire officer's inspection.

What is the fire NOC fee for a factory godown in Gujarat?

For a ground-floor godown over 250 m²: Rs 2,500 for the plan, Rs 10 per m² for the certificate and Rs 2,500 for each renewal, under Annexure 8 of the Regulations 2023. Manufacturing space has no row of its own.

Are the 2021 light, moderate and high hazard lines still in force in Gujarat?

No. They were in the Third Schedule of 22 January 2021. The Second Amendment Rules of 8 July 2021 replaced that schedule with one that lists no industrial buildings.

How long is a Gujarat factory's fire safety certificate valid?

3 years for the first certificate. After that an enrolled Fire Safety Officer renews it for 2 years at a time, with the Regional or Chief Fire Officer's approval.

Does a solvent or LPG store at a factory need a fire NOC in Gujarat?

A hazardous store not covered by the Factories Act is listed at any size. Separately, solvents need a Petroleum Rules licence; the District Magistrate NOC for LPG and CNG under the Gas Cylinders and SMPV Rules was omitted on 5 June 2026.
