Updated By Flamekite Editorial DeskFacts checked against official sources on
Quick answer
Every 2026 fire rule change in India, dated: BIS withdrew NBC 2016 on 30 April 2026 for the voluntary NBCS 2026, the OSH (Central) Rules fixed safety-officer scales on 8 May 2026, the Merchant Shipping Act 2025 took effect on 15 March 2026, and battery storage gets its own fire chapter from 1 April 2027.
Six new state and UT fire laws arrived, from Arunachal Pradesh in May to Manipur in September. Several changes are not yet in force: Delhi's Form K regime is deferred to 20 May 2027 and Madhya Pradesh's Act 16 of 2026 awaits a start date. Telangana's 24 m line covers residential apartments only, from 7 October 2026.

How to check which 2026 change reaches your building
Fix the three facts that decide it
Note your state or UT, your occupancy type and your height in metres. A 21 m apartment block now sits under different lines in Telangana and in Delhi, where the residential trigger is over 15 m or 5 storeys.
See whether your state passed a new law in 2026
Arunachal Pradesh, Manipur, Madhya Pradesh, Lakshadweep, Andaman and Nicobar and DNH and DD all made new fire laws this year. Andhra Pradesh, Uttar Pradesh, Tamil Nadu and Delhi amended theirs.
Find the commencement notification
Assent or publication is not the start date. For MP Act 16 of 2026, UP Act 10 of 2026, the TN Act of 2025 and the A&N Regulation of 2026, Flamekite found no start-date notification by 24 October 2026.
Read the transition clause
Telangana's 7 October 2026 instructions cover only fresh Provisional NOC applications. New ship fire rules apply to keels laid after them. Delhi pushed its amended Rules 34 to 38 back by 270 days.
Work to the date on your own certificate
Renew by the expiry printed on your certificate under the rule in force that day: in Delhi apply 6 months ahead, in Manipur at least 6 months ahead, in Tripura 14 to 30 days ahead.

Safety officers under the OSH Code: what 2026 added
Since 21 November 2025 a factory with 500 or more workers must appoint safety officers under the OSH Code. The Central Rules of 8 May 2026 set how many and with what qualifications, but only for docks, construction and mines.
Section 22(2) of the Occupational Safety, Health and Working Conditions Code, 2020 makes safety officers mandatory in four cases, counting workers ordinarily employed: a factory with 500 or more, a hazardous-process factory with 250 or more, building or construction work with 250 or more, and a mine with 100 or more. The Factories Act's old trigger, in s.40B, was 1,000 workers and applied only where a state notified it.
The OSH (Central) Rules 2026, G.S.R. 345(E) of 8 May 2026, took effect on publication. They cover the Centre's sphere: docks, building and construction, mines and establishments under the Chief Labour Commissioner. Rule 18 sets the scale and qualifications for docks and construction, and Rule 20 covers mines.
Rule 18(2) accepts any one of four routes: an engineering or technology degree with 2 years of supervisory experience, a physics or chemistry degree with 5 years, an engineering diploma with 5 years, or a recognised degree or diploma in industrial safety, including the PG diploma of the Central or Regional Labour Institutes.
Factories mostly fall to the states. Until a state notifies its own OSH rules, its old factory rules continue, the Labour Ministry said when the Codes started. Uttar Pradesh's final OSH Rules, notification No. 962 of 27 August 2026, took effect on publication and replace the UP Factories Rules 1950 and the Safety Officers Rules 1984. Their rule 12 makes NBCS 2026 Part F binding on employers in buildings of 5 or more floors or 20 m, the first state instrument found to apply Part F, and rule 43 requires a safety committee from 250 employees.
The Directorate General of Factory Advice Service and Labour Institutes was renamed the Directorate General Occupational Safety and Health by S.O. 2534(E), reported as published on 15 May 2026.

The MP Act's section-wise amounts were read from a damaged scan and stay off this page until a person proof-reads the gazette copy. UP's Act 10 of 2026 also raises fines and penalties by 10% of the minimum every 3 years after it starts.
Fees the 2026 instruments set or changed
Few 2026 laws set fees in the Act itself; most leave them to rules. These are the amounts that are written down.

Which 2026 change applies to you?
Pick the line that describes you; each points to the change that alters your obligations.
If You are building a residential apartment block in Telangana between 18 m and 24 m
A fresh Provisional NOC application from 7 October 2026 is not required below 24 m. Offices, shops and other occupancies keep their old triggers. Fire NOC Telangana TGFD
If You hold a Delhi fire safety certificate
Renew on the 5-year or 3-year cycle; the yearly Form K regime is due only from 20 May 2027. Fire NOC Delhi Delhi Gazette
If You run a factory with 500 or more workers, or 250 in a hazardous process
Appoint safety officers under s.22(2) of the OSH Code; your state's OSH rules set their number and qualifications. OSH Code
If You own or operate in Maharashtra
Keep filing Form B every January and July through a licensed agency; NBCS 2026 is not yet adopted there. Fire NOC Maharashtra Maharashtra Fire Services
If You build or run a battery energy storage system above 650 V
Plan for CEA Chapter XA from 1 April 2027: fire detection and automatic suppression in each container and a third-party fire audit. CEA
If You build or survey a ship
Ships laid down after the 2026 rules follow the new cargo or passenger fire appliance rules; earlier keels stay under the 1990 rules. DGMA
If You design to the national building standard
NBCS 2026 is voluntary; your state's fire rules decide which edition your plans are judged against. National Building Code 2026 BIS, SP 7:2026
Worked examples: six cases under the 2026 rules
Flamekite’s working from the official rules; no government publishes this figure.
Flamekite's reading of the official texts applied to typical cases. Confirm with the authority before you rely on one.
Case 1
An apartment block in Hyderabad
Residential apartments, 21 m tall, Provisional NOC application filed on 10 October 2026
What applies Below the new 24 m line, so no Provisional NOC from the fire department, and no fire tower or Fire Command Centre room. A 21 m office block is still judged by the old non-residential trigger, because the circular leaves other occupancies unchanged. TGFD
Case 2
A Delhi office renewing in 2027
Non-residential building whose certificate expires on 30 April 2027
What applies Old Rule 36 governs that date, so it renews for 3 years and should apply 6 months ahead, by the end of October 2026. Form K does not apply before 20 May 2027. Delhi Fire Service
Case 3
A central-sphere construction site
Building work with 1,200 workers where the Central Government is the appropriate government
What applies Rule 18 asks for 3 safety officers, the scale for 1,001 to 2,000 workers, each meeting one of the Rule 18(2) qualification routes. Gazette of India
Case 4
A factory in Uttar Pradesh
Non-hazardous factory with 600 workers
What applies Above the 500-worker line in s.22(2), so it must appoint safety officers; under s.40B of the Factories Act it would have been below the 1,000 trigger. The number and qualifications come from UP's 2026 OSH rules. OSH Code
Case 5

How a national change reaches a state rulebook
Fire is a state subject, so a national change binds a building only after a state instrument takes it up. This is the path, with the 2017 precedent and what 2026 did instead.

For owners, builders and safety managers in 2026
Do
- Look up the commencement notification before working to a new Act; for MP Act 16 of 2026 and U.P. Act 10 of 2026 none existed on 24 October 2026. MP Gazette
- If you filed a Telangana Provisional NOC before 7 October 2026, ask TGFD which line applies: the circular covers fresh applications only. TGFD
- Keep Maharashtra's Form B maintenance certificates going each January and July; the July 2026 guidelines require one agency per system group. Maharashtra Fire Services
- Specify automatic suppression for battery containers commissioned on or after 1 April 2027. CEA
Don’t
- Don't skip a Delhi renewal because of the Form K news; until 20 May 2027 the certificate still expires on its 5-year or 3-year date. Delhi Fire Service
- Don't quote UP's ₹75,000 penalty as live; until notified, s.39 still reads up to 3 months and ₹10,000. UP Gazette
- Don't apply Telangana's 24 m line elsewhere: Delhi's residential trigger is still over 15 m or 5 storeys. Delhi Fire Service
- Don't let a safety officer post lapse at a 250-worker construction site or hazardous-process factory. OSH Code

Questions about New fire safety rules 2026
What are the new fire safety rules in 2026?
- The biggest are NBCS 2026 replacing NBC 2016 on 30 April, the OSH (Central) Rules of 8 May, Telangana's 24 m line for apartments from 7 October and six new state and UT fire laws. Delhi's Form K and MP's new Act are passed but not yet in force.
Is a Delhi fire safety certificate valid until cancelled from 2026?
- Not yet. Delhi's notification of 16 October 2026 deferred that rule to 20 May 2027. Until then a residential certificate is renewed after 5 years and a non-residential one, hotels included, after 3 years, with the application 6 months before expiry.
Does a residential building under 24 m in Telangana need a fire NOC?
- A residential apartment block below 24 m needs no Provisional NOC on a fresh application received from 7 October 2026; the old line was 18 m. Commercial and other buildings keep their earlier triggers under circular Rc.No.3455/MSB/2026.
When does a company need a safety officer under the OSH Code?
- When it ordinarily employs 500 or more workers in a factory, 250 or more in a hazardous-process factory or on building work, or 100 or more in a mine. Docks, construction and mines in the Centre's sphere follow the scales in the 2026 Central Rules.
Is the MP Fire and Emergency Services Act 2026 in force?
- It was published on 3 September 2026 as Act 16 of 2026, but it takes effect on dates the state notifies, and Flamekite found no such notification or rules by 24 October 2026.
What did Tamil Nadu change in its fire law in 2026?
- Act 16 of 2026, dated 15 September, amends the Tamil Nadu Fire and Rescue Services Act 2025 to remove references to NBC 2016 and tie fire measures to the state's 2019 building rules. The 2025 Act itself has not yet commenced, so the 1985 Act still applies.
What is the UP fire amendment of 2026?
- U.P. Act 10 of 2026, the Sugamya Vyaapar Act, replaces imprisonment under ss.36 and 39 of the 2022 fire Act with penalties of up to ₹75,000. It starts only on a notified date, which had not been found by 24 October 2026.
Are there new fire rules for battery energy storage?
- Yes. The CEA amendment gazetted on 30 March 2026 adds Chapter XA for battery storage above 650 V, with detection, suppression in every container and a third-party fire audit. It applies from 1 April 2027.
Does the Merchant Shipping Act 2025 change fire rules for ships?
- It replaced the 1958 Act on 15 March 2026, and new cargo and passenger ship fire appliance rules followed on 7 and 13 July 2026. Ships whose keels were laid earlier stay under the 1990 fire appliance rules.
Does Lakshadweep have a fire safety law now?
- Yes, for the first time. Regulation 3 of 2026 took effect on 27 May 2026 and its Rules on 3 September 2026. Certificates are issued within a month and last 5 years.
