National Building Code 2026: what changed when NBC 2016 was withdrawn

Updated By Flamekite Editorial DeskFacts checked against official sources on

Quick answer

On 30 April 2026 the Bureau of Indian Standards withdrew the National Building Code of India 2016 (SP 7:2016) and replaced it, the same day, with the National Building Construction Standards 2026 (SP 7:2026). Fire and life safety is now Part F.

NBCS 2026 calls itself voluntary and non-binding. A high-rise now starts at 24 m instead of 15 m. Your fire NOC is still judged against whatever edition your state's own rules name: only Assam had written NBCS 2026 into its fire law by 24 October 2026. One state uses it for workplaces: Uttar Pradesh's OSH Rules make Part F binding on employers in buildings of 5 or more floors or 20 m, from 27 August 2026.

How to find out which code applies to your building

  1. Find your state's fire law

Start with your state's fire service act and the rules made under it: they, not BIS, decide what a fire NOC needs. Flamekite's state fire NOC pages name each one.

  2. Read how the rules cite the code

Look for the words National Building Code in the definitions. A dated reference, like Delhi's rules naming the National Building Code of India 2005, fixes that edition until the state amends its rules.

  3. Check your building bye-laws

Development control and building bye-laws often set their own fire triggers. Tamil Nadu's 2026 amendment, for example, ties fire measures to its Combined Development and Building Rules, 2019.

  4. Look for a state circular on NBCS 2026

Maharashtra issued circular MFS/2017/60 in May 2017 to enforce NBC 2016 Part 4; a similar circular is how a state would adopt NBCS 2026. Check your fire service's circulars page.

  5. Ask the approving authority in writing

If your state's rules cite the code without a date, ask the fire service which edition it applies to your plans before you submit them, and keep the reply with your file.

What the Gazette notification actually says

The legal notice is two sentences and a one-row schedule. It says nothing about fire, heights or binding force: those come from the standard itself.

Word for word

The Bureau of Indian Standards hereby notifies that Indian standards, particulars of which are given in the second column of the schedule hereto annexed have been established on the date indicated against it in third column.

BIS notification Ref HQ-PUB013/1/2020-PUB-BIS (1529), Gazette of India Extraordinary No. 299, 30 April 2026 Gazette of India

When does Part F apply? Height and floor-area triggers

Part F applies to a building above either the height or the floor area listed for its occupancy. A state or local authority may change these numbers.

Part F also applies to alterations of 1,000 m² or more and to a change of occupancy. Below these triggers, a building with a single staircase must still have it as a fire-fighting shaft on the outside wall, with a 2-hour lobby door and a 1-hour stair door.

The 11 occupancy groups, A to K

Every fire requirement in Part F hangs on the occupancy group. Group K is new in 2026, and data centres now have their own subgroup.

A, Residential
A-I lodging houses for more than 20 people, A-II dormitories (hostels go here), A-III apartment houses for 3 or more families, A-IV hotels up to 4-star, A-V hotels of 5-star and above. BIS, SP 7:2026

State instrument found applying Part F by 24 October 2026: Uttar Pradesh's OSH Rules, for workplaces; none for fire NOCs UP Gazette

No, not by itself. Fire is a state subject, and Part F says it is only for guidance and referral for the state government or local authority.

The Constitution puts fire services with the states and municipalities (Article 243W and the Twelfth Schedule). A fire NOC or fire safety certificate is granted under a state fire act, its rules and the local building bye-laws. A BIS standard becomes binding on your building only when one of those instruments adopts it.

When a state's rules name an edition by date, that edition stays the yardstick until the state changes its rules. The Delhi Fire Service Rules, 2010 define the code as the National Building Code of India 2005 and set minimum fire standards by the building bye-laws or that 2005 edition.

When a state's rules cite the code without a date, it is unclear whether they now point to NBCS 2026 or stay at 2016. Flamekite found no court ruling or state clarification on this as of 24 October 2026, so ask your approving authority in writing which edition it applies.

The Times of India reported that the Cabinet Secretariat's Deregulation Cell had recommended keeping fire and life safety out of the standard altogether, and that it stayed in after pushback from fire safety experts. The report also says the word Code was dropped because courts had read it as binding.

Which edition does your building follow?

Find the line that matches your state's rules.

  1. If Your state's rules name a dated edition, such as NBC 2005 or NBC 2016

That edition applies to your fire NOC until the state amends its rules, even though BIS has withdrawn it. Delhi Fire Service

  2. If Your state's rules say National Building Code with no date

It is unsettled whether this now means NBCS 2026. Ask the fire service in writing before you submit plans. BIS, SP 7:2026

  3. If Your state has removed NBC references from its fire law

Follow the instrument it named instead. Tamil Nadu's 2026 amendment points to its Combined Development and Building Rules, 2019, OISD guidelines and other laws. TeamLease RegTechnews report

  4. If Your state issues a circular adopting NBCS 2026

Part F then applies through that circular. None had been found for fire NOCs by 24 October 2026; Maharashtra has said it intends to. The Times of Indianews report

  5. If Your building is a workplace in Uttar Pradesh with 5 or more floors or a height of 20 m or more

Rule 12 of the UP OSH Rules 2026 already binds the employer or owner to Part F for fire emergencies and lift failures, whatever edition your fire NOC was judged against. OSH Code 2020 UP Gazette

Has any state adopted NBCS 2026?

From news reports, not yet an official source.

One state had written NBCS 2026 into its fire law by 24 October 2026: Assam, by name, from 14 August 2026. One state labour rule applies Part F to workplaces. Flamekite checks state fire service circulars and gazettes and updates this list.

  • Assam's Jan Vishwas Act (Act XIII of 2026) amends its 2025 fire Act: owners must follow "the Building Bye-laws and National Building Construction Standards", defined as the BIS book as revised from time to time, and the Government may relax its provisions by notification. The same amendment drops 15 m from Assam's high-rise definition and leaves the height to the Government. No notification naming SP 7:2026 had followed by 24 October 2026. Assam Act XIII of 2026

  • Uttar Pradesh's OSH Rules 2026 (notification No. 962, in force on publication) require employers and owners of establishments in buildings of 5 or more floors or 20 m to comply with NBCS 2026 Part F. It is a labour rule for workplaces, not a fire NOC rule. UP Gazette

  • Tamil Nadu's Fire and Rescue Services (Amendment) Act, 2026 removes NBC references instead of adopting NBCS, and ties fire measures to its Combined Development and Building Rules, 2019. TeamLease RegTechnews report

  • BIS and IIT Roorkee hold a workshop to strengthen awareness and implementation of NBCS 2026. PIB

What changed inside Part F

The foreword of Part F lists what the 2026 revision changed. These are the changes that alter a design.

  • Clause 3.1.11

Mixed use gets its own group

Group K and a fire-separation matrix replace case-by-case handling of mixed occupancy. BIS, SP 7:2026

  • Table 4

    Travel distances updated

The maximum distances to an exit were revised, and BIS describes them as liberalised. BIS, SP 7:2026

  • Clause 4.5

    Compartmentation rewritten

The rules on dividing a building into fire compartments were rewritten, and water curtains for basement compartmentation were deleted. BIS, SP 7:2026

  • Tables 7A to 7J

    Fire-fighting installations by occupancy

The single Table 7 became ten occupancy tables, with water quantities in Tables 7K and 7M. BIS, SP 7:2026

  • Clause 5.4

    Hazard-specific industrial protection

Detection and suppression for industry are now set by the specific hazard. BIS, SP 7:2026

  • Annex F

    Data centres

A new annex covers data centres, classified as business subgroup E-II. BIS, SP 7:2026

  • Annex M

    Performance-based design

Engineered fire design, directly applicable only to heritage buildings opened to the public or converted. BIS, SP 7:2026

  • IS 18271:2023

    Commercial kitchens

Kitchen fire protection now follows IS 18271:2023 by reference. BIS, SP 7:2026

What the 15 m to 24 m change does not mean

The new high-rise number is the easiest part of NBCS 2026 to misread.

  • If Reading it as "buildings under 24 m no longer need a fire NOC"

Your state's own thresholds still apply. Delhi, for example, sets its residential trigger in its 2010 rules, which still cite NBC 2005. Delhi Fire Service

  • If Assuming the 2016 provisions vanished on 30 April 2026

A state rule that names NBC 2016 keeps it legally in force for that state until the rule is amended. BIS, SP 7:2026

  • If Designing a 15 to 24 m building to the lighter 2026 standard without checking

Several experts warn of a gap for mid-rise buildings; confirm the edition with the fire service before final drawings. SafeSecure Magazinenews report

  • If Treating should as optional on a contract

A contract or tender that names NBCS 2026 makes its provisions binding between the parties, whatever the standard says about itself. BIS, SP 7:2026

For architects, builders and owners in 2026

Do

  • Confirm in writing which edition your fire service applies before final drawings. BIS, SP 7:2026
  • Keep a copy of the edition your approval was granted under (NBC 2005, 2016 or NBCS 2026) with the building file. Delhi Fire Service
  • Watch your state fire service's circulars page: adoption will arrive as a circular or rule amendment. Maharashtra Fire Services

Don’t

  • Don't cancel fire systems in a 15 to 24 m building because the national high-rise number moved to 24 m. BIS, SP 7:2026
  • Don't cite NBC 2016 as current in new tenders; it has been withdrawn since 30 April 2026. Gazette of India
  • Don't assume a neighbouring state's choice applies to yours: Tamil Nadu de-referenced the code while Maharashtra plans to adopt it. TeamLease RegTechnews report

Before you submit building plans in 2026

  • The edition cited (2005, 2016, undated) and the fire service's written answer if undated BIS, SP 7:2026
  • Your occupancy group under both NBC 2016 and NBCS 2026 (A to K) BIS, SP 7:2026

Questions about National Building Code 2026

Is NBC 2016 still valid in 2026?

BIS withdrew NBC 2016 on 30 April 2026, so it is no longer a current Indian standard. But where a state's fire rules or bye-laws name NBC 2016, it still decides fire NOCs in that state until the state changes its rules.

Is NBCS 2026 mandatory?

No. NBCS 2026 describes itself as voluntary and non-binding. It becomes binding for your building only when your state or local authority adopts it, or when a contract names it. Assam's fire law has named it since 14 August 2026, but no other state's fire NOC rules had by 24 October 2026, and Uttar Pradesh's OSH Rules 2026 make Part F binding on workplaces in buildings of 5 or more floors or 20 m.

What is the high-rise height in NBCS 2026?

24 m or above, whatever the occupancy. NBC 2016 used 15 m. Your state may still set its own lower trigger in its fire rules.

Does my 18 m residential building still need a fire NOC?

Very likely yes, because your state's own rules decide, not NBCS 2026. Check your state's fire NOC page; Telangana, for example, moved its residential trigger to 24 m by its own circular, while other states have not.

Where is fire safety in NBCS 2026?

In Part F, Fire and Life Safety. In NBC 2016 the same subject was Part 4.

Where can I get a copy of NBCS 2026?

BIS sells SP 7, Volume 1 and 2 : 2026 on its online standards store. The Goa Directorate of Fire and Emergency Services hosts a copy of Part F published by BIS.

Why was it renamed from a code to a standard?

The Times of India reported that the word Code had led courts to treat the provisions as binding, and the change followed directions from the Deregulation Cell of the Cabinet Secretariat.
