Fire NOC in India: who issues it, which buildings need it, and the rules in all 36 states and UTs

Quick answer

A fire NOC is the fire service's written clearance that a building's fire safety design and installed systems meet the law. India has no national fire NOC: each of the 28 states and 8 union territories issues its own, under its own fire act, rules or building bye-laws.

Most regimes follow the 2019 Model Bill: a certificate for buildings above 15 m, for special occupancies such as schools, hospitals and assembly halls, and for mixed buildings above 500 m². Validity runs from 1 to 5 years by state, and the occupancy certificate usually waits for the fire certificate.

How to apply for a fire NOC online, step by step

  1. Check that your building needs one

Compare its height, the area of its largest floor and its use with your state's list. The common pattern is above 15 m, any special occupancy, or mixed use above 500 m²; the state table on this page names each state's own law.

  2. Find your state's official portal

Use the fire service portal or state single window listed below, not a private site that copies the form. Goa, for example, has taken fire NOC applications only online, on Goa Online, since 15 November 2019.

  3. Have the fire drawings prepared

An architect or engineer draws the fire layout: access, exits, staircases, detection, hydrants and sprinklers. Bihar wants the provisional application through an enrolled architect or engineer, and Kerala has accepted fire plans only on its A1 template since 14 July 2025.

  4. Apply for the provisional NOC and pay the fee

Upload the plans and pay online. Andhra Pradesh charges Rs 10 per m² of built-up area plus a 15% bank guarantee on the fire installation, and its 2026 amendment gives the department 21 days to decide.

  5. Install the systems through a qualified agency

The 2019 Model Bill lets only qualified agencies install fire and life safety systems. Uttar Pradesh licenses such agencies under its 2024 Rules; Maharashtra licenses them in Form M.

  6. Apply for the final certificate and inspection

File the completion notice and request the inspection. Tripura asks for this within 1 month of finishing construction, and the Model Bill gives the fire officer 1 month to issue the certificate.

  7. Use the certificate for your occupancy certificate

Download the digitally signed certificate and file it with the occupancy application: most fire laws bar the occupancy certificate until it exists.

  8. Diary the renewal and maintenance dates

Note the expiry date and any periodic filings. The Model Bill asks for maintenance certificates twice a year, in January and July, and Bihar wants renewal in Form M 45 days before expiry.

What is a fire NOC, who issues it, and is it mandatory?

A fire NOC is mandatory for every building your state's fire law or bye-laws list, and the occupancy certificate usually waits for it. A state or city authority issues it, never a central ministry.

A fire NOC (no objection certificate) is the fire service's written statement that a building's fire prevention and life safety arrangements meet the law. The Ministry of Home Affairs' 2019 Model Bill calls the final approval a Fire Safety Certificate, and states that followed it, such as Andhra Pradesh in 2026, now use that name. West Bengal, Odisha and Tripura call the plan stage a Fire Safety Recommendation; Tamil Nadu calls the final stage a completion certificate or fire licence.

Fire services sit in the Twelfth Schedule of the Constitution (item 7, read with Article 243W), and the Ministry of Home Affairs told the Lok Sabha on 30 July 2024 that fire is a State subject. The Centre advises and funds: its Rs 5,000 crore scheme to expand state fire services, launched on 4 July 2023, keeps Rs 500 crore to reward states for legal and infrastructure reforms.

Three kinds of authority issue the certificate. In most of India it is the state fire service. In Maharashtra the Chief Fire Officer of the municipal or planning authority approves inside its area and the Director outside it, and Gujarat's certificates come from a Regional Fire Officer or a municipal Chief Fire Officer. Rajasthan, which has no separate fire act, issues it through its Local Self Government Department, and Madhya Pradesh's 2026 Act gives operational control to the urban local body.

The certificate is enforced through the permissions that depend on it. The Model Bill bars the occupancy certificate until the fire measures comply, Haryana's 2022 Act says no occupation certificate may issue without it, and Uttar Pradesh refers buildings with a cancelled certificate to the licensing authorities for their trade licences.

Does your building need a fire NOC? Height and area triggers

Start from 15 m, the Model Bill default, then check the exceptions: states set triggers from 9 m to 24 m, and some uses need a NOC at any height.

  1. If Your building is above 15 m

You need one in almost every state: 15 m is the line in the Model Bill and in the laws of Uttar Pradesh, Bihar, Manipur, Nagaland, Sikkim, A&N and DNH and DD. DGFS, MHA

  2. If It is a school, college or hospital of 9 m or more

Delhi, Haryana and Bihar bring educational and institutional buildings in at 9 m, Manipur above 9 m and Nagaland above 9 m or ground plus two, and Bihar covers every assembly building at any height. Bihar Rules 2021

  3. If It is a hotel of 12 m or more

Delhi and Odisha use 12 m for hotels, and Manipur and Nagaland more than 12 m; Chhattisgarh also covers any hotel of 500 m² or of 3-star rating and above. Fire NOC Delhi Home Department, Chhattisgarh

  4. If Any floor exceeds 500 m², or there are 2 or more basements

Andhra Pradesh's 2026 amendment, Bihar and Haryana cover business, mercantile and mixed buildings above 500 m² on any floor, and any building with 2 basements or one basement above 500 m². Andhra Pradesh Legislative Assembly

  5. If It is a residential apartment in Telangana below 24 m

No fire NOC is needed for fresh provisional applications from 7 October 2026; the 24 m line covers residential apartments only. Fire NOC Telangana Telangana Fire, Disaster Response, Emergency and Civil Defence Department

  6. If It is a residential building in Uttarakhand of 12 m or more

Uttarakhand's 2022 amendment sets 12 m, the lowest general residential trigger Flamekite found in any state. Uttarakhand Legislative Assembly

  7. If It is a high-rise in Karnataka

The 2023 amendment ties the high-rise NOC to 21 m, whatever the occupancy. Government of Karnataka

  8. If It is a small building in Tripura

Residential buildings up to 10 m and 500 m², and most other uses up to 10 m and 200 m², use self-certification instead of the full NOC route. Directorate of Fire and Emergency Services, Tripura

How long a fire NOC really takes: Madhya Pradesh's live dashboard

Madhya Pradesh promises a fire NOC in 30 working days in its four largest cities. Its own public dashboard, read on 24 October 2026, shows Bhopal and Indore taking about twice that on average since April 2020; the medians sit closer to the promise, so a tail of slow files drags the average up.

What the Supreme Court ordered for hospitals without a fire NOC

After the Rajkot COVID hospital fire of 26 November 2020, the Court ordered monthly fire audits and an immediate NOC application from every COVID hospital that lacked one.

Word for word

Covid hospitals who have not obtained NOCs from the fire department were required to apply it immediately. These orders were to be followed for the immediate renewal of the NOCs. In the event that any Covid hospital was found not possessing an NOC including a renewal, appropriate action was directed to be taken by the State.

Supreme Court of India, SMW(C) 7/2020, order of 19 July 2021, restating its directions of 18 December 2020 Supreme Court of India

The same directions asked every state for one nodal officer per COVID hospital and a district committee to fire-audit each hospital at least once a month. The MoHFW and NDMA advisory of 23 March 2024 later asked hospitals, through the states, to keep a valid fire NOC renewed annually as per State Fire Safety Rules.

Fire NOC for a hospital, restaurant, hotel, school and coaching centre

The same building gets a different answer in different states. These worked examples apply each state's published rule.

  1. Case 1

A 20 m private hospital with an ICU in Chhattisgarh

    Institutional, above 15 m, with a critical-care unit

What applies Needs a NOC on two counts: institutional above 9 m, and any critical-care unit. Hospitals above 15 m are high risk under the October 2025 order, so the NOC lasts 1 year, with an annual self-declaration and third-party audit report. Fire and Emergency Services and SDRF, Chhattisgarh

  2. Case 2

A nursing home in Uttar Pradesh

    Institutional building below 15 m

What applies Institutional buildings are special buildings under the UP Act, so height does not exempt it. Rule 44 makes a hospital's certificate valid for 1 year, against 5 years for homes. LegitQueststudy

  3. Case 3

    A 40-seat restaurant in Goa

Eating house with up to 50 seats

What applies Pays the small-eatery fee of Rs 150 per NOC per year. A restaurant for more than 50 people pays the licence fee of Rs 10 per m² of built-up area. Directorate of Fire and Emergency Services, Goa

  4. Case 4

A 400 m² restaurant with 8 LPG cylinders in Mumbai

Eating house applying for a trade NOC under section 394 of the MMC Act

What applies Falls in the 50 to 500 m² or up to 10 cylinders tier, so a Station Officer inspects and an ADFO approves it. Inspection and the draft NOC take 7 working days, and rooftop restaurants are a separate risk row. Mumbai Fire Brigade, Municipal Corporation of Greater Mumbai

  5. Case 5

    A 13 m, 4-storey hotel

Hotel in Delhi, Odisha, Manipur or Nagaland

What applies Needs a certificate in all four, because each sets 12 m for hotels. The same hotel at 11 m would clear the height line in those states, but not in states that list hotels by floor area or star rating, such as Chhattisgarh. Government of Manipur

  6. Case 6

    A G+2 school in Puducherry

School up to ground plus 2 floors

What applies Category B: audit certificates from any two licensed agencies. Schools renew every year, although the general term is 3 years. Puducherry G.O. 61

  7. Case 7

A coaching centre in a Rajasthan city

Coaching centre under an urban body

What applies Needs a fire NOC under the UDH order signed on 29 May 2026 and listed on 2 June, which amended the Model Rajasthan Building Regulations 2025. Urban Development and Housing Department, Rajasthan

Fire NOC fees: what each state actually publishes

Most fees are a rate per m² of built-up area, from Rs 2 in Mizoram to Rs 50 in Kerala, and some states charge nothing for the first stage.

As published

Karnataka's Seva Sindhu listing shows Rs 35 or Rs 60 per m² for a high-rise NOC; see the fees page. Tamil Nadu's single-window sheets say no fees are collected. Three generations of law sit side by side: fire brigade acts of the 1950s and 1960s, certification regimes of the 1990s and 2000s, and Model Bill acts since 2012.

  1. 1950

West Bengal Fire Services Act, still the base law there; a 2018 amendment added the 3-year certificate. West Bengal Legislative Assembly

  2. 1958

The Centre circulates the Model Fire Force Bill, the first template for state fire acts. DGFS, MHA

  3. 1964

Karnataka Fire Force Act; the high-rise NOC power arrives only with the 2023 amendment. Government of Karnataka

  4. 1967

Jammu and Kashmir Fire Force Act, still applied in J&K and Ladakh, with a Rs 500 precaution fine. PRS copy

  5. 1985

Assam Fire Service Act, with its Rules of 1989 tying the NOC to the trade licence; replaced on 24 December 2025 by the Assam Fire and Emergency Services Act 2025. Assam Act LIII of 2025

  6. 1993

Odisha Fire Service Act (Act 30 of 1993), later given Fire Prevention and Fire Safety Rules in 2017. Home Department, Odisha

  7. 2006

Maharashtra Fire Prevention and Life Safety Measures Act, the precursor of the modern pattern. Maharashtra Fire and Emergency Services

  8. 2007

Delhi Fire Service Act, followed by the Delhi Fire Service Rules, 2010. Delhi Fire Service

  9. 2013

Gujarat Fire Prevention and Life Safety Measures Act, later run on the GujFireSafety CoP portal. LegitQueststudy

  10. 2019

MHA revises the Model Bill: Fire Safety Certificate in 1 month, qualified agencies, Fire Safety Officers, fire tax. DGFS, MHA

  11. 2022

Haryana, Uttar Pradesh and Tripura pass Model Bill style acts. Government of Haryana

  12. 2024

Jharkhand and Punjab follow; Punjab's Act makes a certificate last ordinarily at least 3 years. Punjab Gazette

  13. 6 June 2025

Tamil Nadu gazettes its Fire and Rescue Services Act 2025, still awaiting commencement. Government of Tamil Nadu, Gazette Extraordinary No. 263, 6 June 2025

  14. 2026

Six new instruments in one year: the MP, Arunachal and Manipur acts and the A&N, DNH and DD and Lakshadweep regulations. Government of Manipur

Fire NOC changes in 2026, latest first

Official fire NOC portals you can apply on

Apply only on these government addresses, each published by the state's own fire service or single window. All 21 were checked on 24 October 2026.

Documents required for a fire NOC application

Lists differ by state and stage, but these items recur in the official checklists Flamekite read in 2026.

Fire NOC mistakes that cost owners months or a sealed building

Most rejections and closures trace back to six avoidable errors.

  • If Letting the certificate expire before renewing

In Assam an expired NOC needs a fresh application, not a renewal. Apply early; Odisha's certificates ask for renewal at least 3 months before expiry. Fire and Emergency Services, Assam

  • If Trusting an old official page over the gazette

Goa's flowchart still says one year although its 23 June 2025 notification set 5 years. Read the newest gazette, and check its commencement date. Government of Goa, Official Gazette Series II No. 14, 3 July 2025

  • If Reading the NBCS 2026 high-rise line of 24 m as a NOC exemption

NBCS 2026 is voluntary and only Assam had written it into its fire law by 24 October 2026; your state's own trigger still applies, and Telangana moved its residential line to 24 m only by its own circular. BIS, SP 7:2026

  • If Moving in before the final certificate

The occupancy certificate is barred until the fire measures comply, and section 57 of the Model Bill lets the fire service seal the premises. DGFS, MHA

  • If Picking a third-party auditor casually in Chhattisgarh

The state portal warns that once you select an auditor the choice is final, so compare auditors before you click. Fire and Emergency Services and SDRF, Chhattisgarh

  • If Submitting fire plans in an old format in Kerala

Since 14 July 2025 the Kerala portal accepts fire plans only on its A1 template. Kerala Fire and Rescue Services

Renewal windows run from 2 weeks to 6 months before expiry, depending on the state.

Questions about Fire NOC

What is a fire NOC?

A fire NOC is a certificate from your state's fire service saying that a building's fire safety plans, or its installed fire systems, meet the state's fire law. It comes in two stages: a provisional NOC before construction and a final NOC or fire safety certificate before occupation.

Is a fire NOC mandatory for every building?

No. It is mandatory for the buildings your state lists: usually those above 15 m, special occupancies such as schools, hospitals, hotels and assembly halls, and mixed buildings with a floor above 500 m². A small home below your state's trigger usually needs none.

Who issues a fire NOC in India?

The state or UT fire service in most of India, a municipal Chief Fire Officer in Maharashtra's corporations, and the Local Self Government Department in Rajasthan. No central ministry issues one.

How long is a fire NOC valid?

It depends on the state: 1 year for high-risk premises in Chhattisgarh and Uttar Pradesh, 3 years in Gujarat, Haryana and West Bengal, and 5 years in Goa, Kerala (non-hazardous), Lakshadweep and DNH and DD.

How do I write an application for a fire NOC?

In most states you no longer write a letter: you fill in the state's online form and upload the drawings. Where paper is still used, use the prescribed form, such as Form D at a Nagaland fire station, and attach the plans and your previous NOC. The application format page lists the form for each state.

Can I get a fire NOC online?

Yes, in most states: Bihar, Chhattisgarh, Goa, Gujarat, Kerala, Uttar Pradesh and West Bengal, among others, run official portals. Ladakh's fire service website, launched on 6 October 2026, had no public address by 24 October 2026; Manipur and Nagaland opened their routes in 2026, and Sikkim's 2025 Rules require online applications through a portal that did not respond.

How long does a fire NOC take?

On paper, from 3 working days for an Andhra Pradesh provisional NOC (by circular; its Act says 21 days) to 60 working days for a Karnataka high-rise NOC; the Model Bill says 1 month. In practice, Madhya Pradesh's own dashboard shows Jabalpur averaging under 28 days and Bhopal about 61 days against a promise of 30 working days.

What is the fee for a fire NOC?

Usually a rate per m² of built-up area: Rs 10 in Andhra Pradesh and Telangana, Rs 12 to Rs 50 in Kerala, Rs 2 to Rs 4 in Mizoram. Goa's initial NOC and Puducherry's NOC are free.
