Fire NOC in Jammu and Kashmir: the Fire and Emergency Services NOC

Updated By Flamekite Editorial DeskFacts checked against official sources on

Quick answer

J&K's Fire and Emergency Services issues the fire NOC under the 2021 building bye-laws; since 12 October 2026 the building NOC is due within 21 days. Clause 2.18(2) of the J&K Unified Building Bye-Laws, 2021 requires it for assembly and intensive commercial and residential buildings: group housing, commercial and public semi-public use, or as the local body notifies.

The J&K Fire Force Act, 1967, continued for the Union territory by S.O. 1229(E) of 31 March 2020, still runs the service but sets no certificate, fee or validity; its precaution fine is ₹500. Owners file through the H&UDD building permission portal and the J&K Single Window, which runs a provisional and a final or renewal NOC. No fee schedule or validity period is published.

How to get a fire NOC in Jammu and Kashmir, step by step

  1. Find your use class in the bye-laws

Clause 2.18(2) names group housing, commercial and public semi-public buildings; the 2021 text lists classes R3, C3, C4, C5 and PSP1 to PSP4. Hotels, hospitals, cinemas, schools and apartment blocks all fall inside.

  2. Have a Registered Technical Person draw the fire plans

Buildings of 15 m or more, and special buildings over 500 m², are sanctioned in 2 stages, with 17 fire items on the Stage 1 plans, from fire tender access to sprinklers and wet risers.

  3. File one Common Application Form online

Since S.O. 304 of 1 December 2025, the RTP uploads the plans on H&UDD's Building Permission Portal, and the fire NOC is routed online with the other NOCs. No paper request is needed.

  4. Get the fire NOC within 21 days

The Joint Director, Fire and Emergency Services, is the designated officer. If the 21 days pass, appeal to the Director General, then to the Administrative Secretary, Home Department.

  5. Build, then apply for the occupancy-cum-completion certificate

Upload a completion certificate, as-built drawings and photographs of the fire safety provisions. The BPIA issues the certificate within 15 days after field verification.

  6. Register the running business with the fire service

A hotel, guest house, restaurant or joinery mill files the Final Registration NOC on the J&K Single Window, with a site plan, building plan, Intikhab or rent deed and photograph, and later the renewal NOC.

Section 13 of the J&K Fire Force Act, 1967, word for word

Section 13 is the only clause in the 1967 Act that reaches private buildings, and it works by notification, not by certificate.

Word for word

(1) The Government may, by notification in the Official Gazette, require owners or occupiers of premises in any area or of any class of premises used for purposes which in its opinion are likely to cause a risk of fire, to take such precautions as may be specified in such notification. (2) Where a notification has been issued under sub-section (1), it shall be lawful for the Director or any officer or class of officers of the force authorized by the Government in this behalf to direct the removal of objects or goods likely to cause a risk of fire, to a place of safety; and on failure of the owner or occupier to do so, the Director or such officer may, after giving the owner or occupier a reasonable opportunity of making representation, seize, detain or remove such objects or goods.

Jammu and Kashmir Fire Force Act, 1967 (Act No. XXII of 1967), section 13, with "Official Gazette" as substituted by S.O. 1229(E) of 31 March 2020 PRS copy

Three things follow. The fire NOC a J&K owner applies for is not created by this Act: it comes from the 2021 building bye-laws and the service notifications of 2017 and 2026. Section 22 punishes a breach of a section 13 notification with a fine of up to ₹500, the figure set in 1967. And Flamekite found no section 13 notification listing classes of premises, so the section 31 power to enter notified places has no published list behind it.

What Flamekite could not confirm about J&K fire NOC

Seven points no official J&K source we read settles, as of 24 October 2026.

The fee. No notification, Single Window fee file or department page sets a fire NOC fee. The ₹500 and ₹1,000 that one guide prints, payable by demand draft to an "Accounts Officer", have no official copy behind them.

The validity. The Single Window runs a "Final/Renewal NOC", so NOCs are renewed, but no term was found. The one-year figure on a wiki guide is unsourced.

Section 13 notifications. The 1967 Act lets the Government notify classes of premises and the precautions they must take. Flamekite found none, and no fire rules under section 37 beyond the 1990 service rules.

The department's own pages. fireandemergency.jk.gov.in, which search engines index with a "NOC for Fire Safety: Procedure and Timelines" page, did not resolve on 24 October 2026, and the web archive was offline.

Small guest houses. The 2021 list names classes C3 and C4 but not C2, where guest houses and restaurants sit; S.O. 304's word "Commercial" reads wider. No circular says which reading the fire service applies.

The houseboat policy text. Its fire clause is known only from news reports of March 2021; the policy document itself was not found.

Which code applies after 30 April 2026. Clause 14.2 points to NBC 2016 "or its latest version". Whether J&K reads that as NBCS 2026 for fire NOCs is not confirmed; only Assam had written NBCS 2026 into its fire law by 24 October 2026.

Who issues fire NOC in Jammu and Srinagar?

The Fire and Emergency Services Department of the J&K Home Department. For building permission the designated officer is the Joint Director, under S.O. 260 of 12 October 2026; fire safety recommendations for hotels and guest houses come from the concerned district office under SRO-493 of 2017.

Not published. Flamekite found no J&K notification or Single Window fee file setting a fire NOC fee on 24 October 2026. The ₹500 and ₹1,000 figures in one private guide have no official source, so confirm the amount on the portal before paying.

Do hotels and houseboats in Srinagar need a fire NOC?

Hotels, yes: classes C3 and C4 are in the bye-laws' fire NOC list, and the Single Window runs a final registration NOC for hotels and guest houses. Houseboats on Dal and Nigeen must carry fire safety equipment and trained staff verified by Fire and Emergency Services, as the 2021 policy was reported.

Which law governs fire safety in J&K after 2019?

The J&K Fire Force Act, 1967, continued for the Union territory by S.O. 1229(E) of 31 March 2020. It runs the fire service and fines a breach of a precaution notice up to ₹500; the NOC itself sits in the 2021 building bye-laws.
