Updated By Flamekite Editorial DeskFacts checked against official sources on

Quick answer

A Bihar fire NOC costs ₹2 to ₹10 per m² of total floor area at the provisional stage, plus a bank guarantee of 15% of the fire-system estimate held for 5 years. Under rule 15 of the Bihar Fire Service Rules, 2021 it is valid 5 years for homes, 3 years for other buildings and 2 years for hazardous ones.

Bihar Fire Service issues it in three stages on firenoc.bihar.gov.in: a provisional NOC on Form E before you build, a final NOC on Form J after inspection, and a renewal applied for on Form M 45 days before expiry. Schedule D of the Rules says the NOC is uploaded within 15 days once the file is in order.

How to get a fire NOC in Bihar, from Form B to Form J

  1. Test the building against rule 15(a)

Check the height (15 m, or 9 m for schools and institutions), the largest floor (500 m², or 300 m² used for assembly), the basements and the use. Any assembly building needs a NOC at any size.

  2. Have an enrolled architect or engineer file Form B

Before construction, the application goes to the Director through an architect or engineer enrolled with the Building Construction Department or the local body, with the plan, the Form C checklist and the Form D undertakings.

  3. Lodge the 15% bank guarantee and pay the provisional fee

Submit the fire-system estimate and a 5-year bank guarantee for 15% of it, and pay the Schedule C provisional rate, ₹2 to ₹10 per m² of all floors.

  4. Fix any plan defect within 30 days

The Fire Prevention and Safety Wing may direct changes; a plan not corrected within 30 days may be rejected. A resubmission after a Form F rejection carries no second fee.

  5. Report the start a week ahead, then every 6 months

Tell the Director one week before work starts and every 6 months while it runs (Form G). Officers may inspect during construction and record deviations on Form H.

  6. File the completion notice and pass inspection

Send Form I to Bihar Fire Service and to the plan authority. Officers check the installed systems against the provisional NOC and issue the final NOC on Form J, or directions on Form K.

  7. Renew on Form M 45 days before the term ends

Homes renew every 5 years, other buildings every 3 and hazardous ones every 2. A renewal certificate is issued on Form N after inspection.

What rule 15(a) of the Bihar Fire Service Rules 2021 says

Six clauses of one rule decide whether a Bihar building must hold a fire NOC.

Word for word

(i) Multi-storey buildings of all categories (with height of 15 meters and above) or Ground coverage more than 500 Mtr. square (Any Floor). (ii) Special buildings like hotel, educational, institutional, business, mercantile, industrial, storage, hazardous and mixed occupancies, where the floor area of any one or more floors exceeds 500 Sq. meters in any such type of buildings. (iii) Educational, institutional building with a height of 9 meters or more (iv) All the assembly buildings. (v) Building having area more than 300 square meters on any floor, used for assembly or marked for the assembly. (vi) Building with two or more than two basements or building having one basement with an area of more than 500 square meters.

Rule 15(a), Bihar Fire Service Rules, 2021, Government of Bihar, Home Department (official English copy) Bihar Rules 2021

Clause (i) reaches far below a high-rise: a 2-storey building with a 600 m² floor is covered whatever its use. Clause (vii) adds that other owners may adopt the National Building Code 2016 Part 4 measures by choice, and rule 15(b) makes the NOC compulsory for every building the six clauses name.

Bihar fire NOC validity by occupancy under rule 15(j)

Rule 15(j) gives each class its own term, and the renewal runs for the same term unless the Director General changes it.

Bihar fire NOC costs beyond the Schedule C fee

The per-m² fee is the smaller bill in Bihar. The guarantee, the tax and the fines below sit on top of it.

Patna fire audits and sealing orders of 2026

From news reports, not yet an official source.

Patna's 2026 drive ran from hospitals and hotels in June to factories and Patna City shops in July. The orders came from the fire service and district; Flamekite found no change to the 2021 Rules after it, as of 24 October 2026.

  • Patna Press reports 239 establishments warned of sealing after 15 June: 161 hotels and 78 private hospitals. Of 462 hospitals audited a year earlier, 384 were compliant; of 241 hotels, 80. Patna Pressnews report

  • The state orders 5 hospitals and 6 hotels in Patna sealed. 27 audit teams across 9 Patna fire stations have checked about 250 premises, and notices have gone to 32 major hospitals and 40 hotels and restaurants. Patna Pressnews report

  • After an oil factory fire in Didarganj, the audits turn to factories and warehouses: Patna has an estimated 700 to 1,000 units, 150 to 200 of them high-risk. Patna Pressnews report

Why Bihar fire NOC files stall or get cancelled

Most Bihar setbacks trace to a dated step in rule 15 that was missed. Here are 7.

  • If A plan change the Wing asked for is not made in 30 days

Rule 14(h) lets the plan be rejected. Diary the 30 days from the direction and answer inside them. Bihar Rules 2021

  • If The UID slip is not followed by the hard copy

Schedule D voids the slip unless the papers reach the Director's office, and you start again from the returning-user window. Bihar Rules 2021

  • If Work starts without the one-week notice

File Form G a week before the start and every 6 months after; officers may inspect during construction. Bihar Rules 2021

  • If The building is used for a different class than the application

Rule 15(h) ties the NOC to the occupancy class and occupant load you declared; a change of category needs a fresh NOC. Bihar Rules 2021

  • If Renewal filed in the last weeks of the term

Form M is due 45 days before expiry, and the renewal needs an inspection before Form N issues. Bihar Rules 2021

  • If Systems not maintained after the final NOC

Rule 15(k) lets the NOC be cancelled on Form O, after which the building may not be used for public or commercial purposes; appeal within 90 days. Bihar Rules 2021

  • If An older NOC that the portal cannot find

Search it by its legacy file number; Bihar Fire Service officers must verify it before a final or renewal application can proceed. BFS NOC manual

Keeping a Bihar fire NOC valid between renewals

Do

  • Keep the 15% bank guarantee alive for its full 5 years; the Fire Department may draw on it to restore neglected systems. Bihar Rules 2021
  • Send the Form Q self-assessment on fire measures at the interval your fire officer sets. Bihar Rules 2021
  • Appoint a trained Fire Safety Officer if section 29 lists your building, such as a hotel of 100 rooms or a hospital of over 500 beds. Bihar Act 6 of 2014
  • Have the wiring certified by an electrical engineer every 5 years for apartments and every 2 years for other uses, as Schedule H asks of old buildings. Bihar Rules 2021

Don’t

  • Don't park in the 6 m fire access round the building; Schedule H wants it kept clear. Bihar Rules 2021
  • Don't hand over flats with fire systems unfinished: rule 22(g) makes the builder answerable at handover, and the owners' association maintains them after. Bihar Rules 2021
  • Don't break a fire service seal: section 44(5) carries up to 3 months or ₹25,000. Bihar Act 6 of 2014

The Act's commencement notifications. Section 1(3) brings it into force by notification, area by area. The portal says it was implemented across the state in 2014, but we did not read the notification itself.

How Schedule C maps hotels, malls and hospitals. Rule 15(d) speaks of 4 fee categories, Schedule C prints 5 rows, and neither names hotels or health buildings, which rule 15(j) treats separately.

The full compounding ladder. The official English copy of rule 33 shows only the District Fire Officer's ₹5,000 limit; a legal database's text adds ₹10,000 for a Divisional Fire Officer, which we could not see in the official copy.

Whether NBC 2016 "as amended from time to time" now carries SP 7:2026 for Bihar fire NOCs. No Bihar order on it was found.

An official document list, and whether local bodies such as Patna Municipal Corporation actually collect the 2.5% fire tax. Patna's plan-approval portal lists a Fire Approval resource that leads nowhere.
