Fire NOC for a cold storage: licences, ammonia rules, state lines and steps

Updated By Flamekite Editorial DeskFacts checked against official sources on

Quick answer

A cold storage is NBC Group H storage, kept below 15 m. Delhi wants a fire NOC above 250 m²; UP and West Bengal also license cold stores under their own Acts.

Both national codes list cold storage premises as moderate hazard. Above 250 m² a single-floor store needs a wet riser, yard hydrant, sprinklers, detection and a 50,000 litre tank under NBC 2016 Table 7, and the ammonia plant brings its own rules: detectors, a water curtain round the receiver and drills every quarter in Telangana.

How to get a fire NOC and licence for a cold storage: 9 steps

  1. Settle the class: Group H, moderate hazard

A cold store is Group H. Check the ammonia: NBC 2016 puts buildings storing ammonia under pressure in quantities over 70 m³ in Group J, the hazardous group.

  2. Keep the building under the state's height cap

15 m under NBC 2016 and in Uttar Pradesh, 21 m in Haryana, 24 m in Maharashtra subject to local fire-fighting facilities.

  3. Take the cold storage construction permission

Uttar Pradesh (s.9 of the 1976 Act) and West Bengal (s.2A of the 1966 Act) bar building a new cold store without the Licensing Officer's prior permission.

  4. Size the fire systems by floor area and storeys

NBC 2016 Table 7 changes at 250 m² and at each added floor; Maharashtra changes at 1,000 m²; NBCS 2026 at 500, 1,000 and 2,000 m² and for racks.

  5. Choose and detail the insulation

Line both faces of any combustible lining to the required flame spread class, fit pressure relief ports in panel chambers, and keep panel joints sealed as NHB's standard sets out.

  6. Engineer the ammonia plant for a leak and a fire

Detectors in the machine room and chamber vestibules, a water curtain round the receiver, relief valves piped to a scrubber, and automatic isolation of the charge in a fire.

  7. Apply for the fire certificate before you store

Apply on the state portal once the systems are installed and tested; the fire documents list and the online apply page show what each state asks.

  8. Take the cold storage licence and the insurance

UP's s.5 and West Bengal's s.3 bar the business without a licence; UP's s.23 and West Bengal's s.15 make fire insurance a duty of the licensee.

  9. Diary renewals, filings and drills

West Bengal's licence renewal goes in 45 days before expiry; Maharashtra files Form B each January and July; Telangana's alert wants ammonia drills every quarter.

Where a cold storage sits in the fire codes: Group H, G2 and J

Both codes put a cold store in Group H, storage, and their hazard tables call it moderate hazard. The ammonia that cools it can pull a building into Group J.

Group H, NBC 2016 clause 3.1.9
Buildings used mainly to store goods, vehicles or animals, with cold storages named among the examples. A new use that brings many more people in, such as offices, changes the class. BIS, NBC 2016 Part 4
Group H, NBCS 2026
The 2026 standard repeats the definition and the cold storage example word for word in substance. It is voluntary; only Assam had written NBCS 2026 into its fire law by 24 October 2026. BIS, SP 7:2026
Moderate hazard, NBC 2016 Annex B
"Cold Storage Premises" sit in the moderate hazard column, beside cork, coir and dry cleaning, read off the page image. BIS, NBC 2016 Part 4
G2, NBCS 2026 Annex B
"Cold storage premises" and "Cold Freezer Room" both sit in the G2 moderate hazard column of the 2026 table. BIS, SP 7:2026
Group J, clause 3.1.10(a)
Hazardous buildings include those storing gases such as ammonia under a pressure above 0.1 N/mm² in quantities over 70 m³. The clause does not say how a refrigeration charge is counted. BIS, NBC 2016 Part 4
Fire Zone No. 3
NBC 2016 groups storage buildings with high hazard industry and hazardous uses in the third fire zone of a planned city. BIS, NBC 2016 Part 4
Cold storage, UP Act 1976
An enclosed chamber insulated and cooled by refrigeration machinery for farm produce; cabinets and chilling plants under 100 m³ are left out. LawGistnews report

Maharashtra's Note 18 asks the whole occupancy to be protected by hydrants, sprinklers, spray, mist, gas, foam and alarms as the Indian Standards apply, and Note 21(b) asks another agent where water is unsuitable. NBCS 2026 Remark 1 recommends a dry riser where the ambient temperature is below 4 °C, which fits a freezer block. The general warehouse grid, with multi-level car parks, is on the warehouse page.

What West Bengal's 1966 Act says about insuring a cold storage

Section 15 of the West Bengal Act makes insurance of the whole cold store a legal duty. Read off the page image of the Act as amended in 1978.

Word for word

Cold storage building, cold storage machinery and the agricultural produce stored in a cold storage shall be insured against such items of risks and with such Insurance Company or Companies as may be determined by the Licensing Officer from time to time

The West Bengal Cold Storage (Licensing and Regulation) Act, 1966, section 15, as substituted by West Ben. Act LXXI of 1978 (printed page 43) WB Cold Storage Act

The proviso makes the hirer pay a pro-rata premium on the produce alone. Uttar Pradesh's section 23 is narrower: the licensee insures the stored produce against fire and breakdown, and says nothing of the building. Neither Act names a fire certificate; Flamekite did not find either state's cold storage Rules, where a fire condition could sit.

4 fire rules that tie a cold storage licence to the fire certificate

Four states' fire rules name cold storage among the licences that fall with the fire certificate. In each, a cancelled certificate goes to the licensing authority.

  1. Uttar Pradesh: rule 46 of 2024

After a show-cause notice within 24 hours and 15 days to reply, the fire officer reports to the licensing authority to cancel the licence of a cold storage, among others; sealing under rule 47 follows if it does not act. UP Rules 2024

  2. Odisha: Order 50908 of 2019

An officer who cancels a certificate reports to the licensing authority for cinema, clinic, factory, hotel, warehouse and cold storage licences; prosecution needs sanction. Order 50908 of 2019

  3. Sikkim: rule 32 of 2025

The same show-cause steps, 24 hours and 15 days, then a Form A16 report to the licensing authority of the cold storage. Sikkim F&ES Rules 2025

  4. Chhattisgarh: rule 35 of 2021

No authority may issue or renew a licence for a warehouse or cold store without working fire systems and a valid fire certificate. CG Gazette

Ammonia plant safety in a cold storage: 12 points from the rules

Telangana's Directorate of Factories issued Safety Alert 10/2026 in June 2026 for cold storage units with ammonia chilling plants; NHB's 2010 standard and the MSIHC Rules add the rest.

  • Ammonia is a listed hazardous chemical: the MSIHC Rules set 50 t and 500 t in Schedule 3 and 60 t and 600 t in Schedule 2, counting installations of one occupier less than 500 m apart. MSIHC Rules 1989
  • Fit fixed ammonia detectors in the machine room, the cold chamber vestibules, the control room and the condenser area, alarming in sound and light outside the room. Telangana Factories
  • Calibrate the gas detectors every 6 months and keep the records. Telangana Factories
  • Put a water curtain round the ammonia receivers; NHB's standard also asks sprinklers over high-pressure receivers. Telangana Factories
  • Pipe relief valve discharge to a water absorption or scrubber tank, never to open air or an occupied area; NHB asks a safety release to a water sump. Telangana Factories
  • Test relief valves every 12 months and after any release; pressure or leak test the pipelines at least every 3 years. Telangana Factories
  • Provide emergency shut-off valves on the main receivers and suction headers, and automatic isolation of the refrigerant charge in a fire. Telangana Factories
  • Keep at least 2 self-contained breathing sets with spare cylinders outside the compressor room, and inspect the PPE every 6 months. Telangana Factories
  • Run ammonia mock drills at least once a quarter, announced and unannounced, and record what went wrong. Telangana Factories
  • Keep a written on-site emergency plan where MSIHC rule 13 applies, or an emergency response procedure, agreed with the local fire brigade and hospital. Telangana Factories
  • Fit fire sensors in the chambers and machine room, emergency ventilation for the machine room, and alarm switches near every cold store door (NHB-CS-Type 01-2010). NHB standards
  • Run the self-inspection checklist at least every 3 months: 14 items from vessel certificates to colour-coded piping. Telangana Factories

PUF and EPS insulated panels in a cold storage: 5 dos and 4 don'ts

The codes do not name PUF or EPS panels, so these lines come from the clauses that govern combustible linings and from NHB's cold storage standard. Each line names its source.

Do

  • Make both faces of a combustible lining meet the flame spread class the location needs: the codes warn that fire spreads unseen in a concealed cavity (NBCS 2026, 3.5.10.5). BIS, SP 7:2026
  • Fit enough pressure relief ports on every insulated panel chamber (NHB-CS-Type 01-2010). NHB standards
  • Seal panel joints with cam locks or tongue and groove, and flash every concrete and wall to ceiling joint inside and out (NHB). NHB standards
  • Count the insulation in the fire load: polystyrene carries 41.8 and polyurethane 35.2 thousand kJ per kg, 2.38 and 2.00 times wood (NBCS 2026, Table 12). BIS, SP 7:2026
  • Protect any combustible storage, packing, fuel or boiler area in a storage building to level CL-6 (NBCS 2026, Table 7H Note 1). BIS, SP 7:2026

Don’t

  • Don't use Class 2 surfaces on walls, staircases or corridors; only Class 1 may go anywhere (NBCS 2026, 3.5.10.3). BIS, SP 7:2026
  • Don't wrap duct insulation in combustible material; insulation for ducts should be non-combustible (NBCS 2026, 3.5.7.3.5). BIS, SP 7:2026
  • Don't treat the 150 mm EPS or 100 mm PUF wall in NHB's table as a fire rating: it is a thermal thickness for a U value of 0.27 W/m²K. NHB standards
  • Don't rely on sprinklers alone where the stored goods react with water: Maharashtra's Note 21(b) asks a suitable other agent. MH Act 2023 Schedule-I

Where cold storages fail, and the fix: 7 cases

These are the failures the instruments and the post-incident reports point to for cold stores.

  • If Building up or adding a floor without permission

Take the Licensing Officer's permission and a revised fire approval first. Police said the Chandausi roof that fell in 2023 had been built 3 months earlier without permission, as reported. National Heraldnews report

Cold storage collapses and ammonia leaks: Chandausi 2023 to Tiruvallur 2026

From news reports, not yet an official source.

News reports only: Flamekite found no official probe report or government order for these events on 25 October 2026. Tolls differ between reports. The rules in force are in the sections above.

  • The roof of a cold storage in Chandausi, Sambhal district, UP, fell during potato loading; 10 dead among 21 pulled out by then. Ammonia cylinders kept in the store slowed rescue; the Chief Minister set up a probe. National Heraldnews report

What Flamekite could not confirm about cold storage fire NOCs

These 8 points are where a reader would expect an answer and no official source gave one on 25 October 2026.

  • The official UP Act: India Code refused access, so this page reads it from a legal database copy and says so.
  • The UP and West Bengal cold storage Rules: their licence periods, fees, building specifications and any fire condition were not found online.
  • Whether Punjab has a cold storage licensing Act: none found.
  • The text of IS 3594:2024, including its stack heights, compartment sizes and the new height for multi-storey cold stores: BIS sells it, and Flamekite has not read it.
  • How NBC 2016's Group J test (ammonia under pressure above 70 m³) applies to a refrigeration plant's own charge: no clause or circular says.
  • Which MSIHC schedule a refrigeration plant falls under: Telangana's alert names 50 t as Schedule 1, while the Rules print 50 t in Schedule 3 and 60 t in Schedule 2.
  • Whether NHB's subsidy rates on its page, which carries a 2010 footer, are still the rates in force.
  • Whether West Bengal's 19 high-risk occupancies take in a cold store above the 500 m² self-certification limit.

Questions about fire NOCs for cold storages

Is a fire NOC mandatory for a cold storage?

Above your state's line, yes. Uttar Pradesh covers every storage building; Delhi, Gujarat, Rajasthan, Chhattisgarh, Manipur and Nagaland draw the line above 250 m²; Haryana, Bihar and Odisha near 500 m². Most cold storage states also want a separate cold storage licence.

Which NBC occupancy is a cold storage?

Group H, storage. NBC 2016 clause 3.1.9 names cold storages among its examples and its Annex B puts cold storage premises in moderate hazard. NBCS 2026 keeps both and adds cold freezer rooms to the moderate column.

Who issues a cold storage licence?

In Uttar Pradesh the Director of Horticulture and Fruit Utilization under the 1976 Act; in West Bengal the Director of Agriculture, the Additional Director (Marketing) or an empowered District Magistrate under the 1966 Act. Both also need permission before a new store is built.

What fire systems does a cold storage need?

Under NBC 2016, a store under 250 m² needs extinguishers, hose reels, sprinklers and a 25,000 litre terrace tank. Above 250 m² add a wet riser, yard hydrant, alarm, detection, a 50,000 to 1,00,000 litre underground tank and a pump set.

Is ammonia in a cold storage covered by the hazardous chemical rules?

Ammonia is listed in the MSIHC Rules 1989, with 50 t and 500 t in Schedule 3 and 60 t and 600 t in Schedule 2. Telangana's 2026 alert applies to cold storage ammonia plants whatever their charge.

How tall can a cold storage building be?

NBC 2016 permits no storage building above 15 m, and Uttar Pradesh repeats it. Haryana allows storage to 21 m, and Maharashtra up to 24 m where local fire-fighting can serve it.

Does a cold storage need fire insurance?

In Uttar Pradesh the licensee must insure the stored produce against fire and breakdown (s.23). In West Bengal the building, machinery and produce must be insured as the Licensing Officer decides (s.15).

Are PUF panels allowed in a cold storage?

The codes do not ban them by name. They ask linings to meet a flame spread class on both faces, rate polyurethane at 35.2 thousand kJ per kg in the fire load table, and NHB lists PUF and EPS among usual insulation.
