Fire NOC in Dadra and Nagar Haveli and Daman and Diu: Daman, Silvassa and Diu

Updated By Flamekite Editorial DeskFacts checked against official sources on

Quick answer

Since 7 July 2026 a fire NOC in Daman, Diu or Silvassa is a Fire Safety Certificate under the Dadra and Nagar Haveli and Daman and Diu Fire and Emergency Service Regulation, 2026 (No. 6 of 2026). It is valid for 5 years, with a self-declaration of operational fitness after 30 months and a maintenance declaration every July. The Regulation repealed the Goa, Daman and Diu Fire Force Act, 1986 across the Union territory.

The UT's Department of Fire and Emergency Services, headquartered at Somnath, Nani Daman, runs three online services: a provisional NOC before building permission, a final NOC before occupation and a renewal. The 2025 SOPs still charge ₹10 per m² of total built-up area including the basement, once, and ₹2,500 for a renewal, with no late fee at present. Factories in Dadra and Nagar Haveli take the provisional NOC as a pre-establishment clearance and the final NOC before operation.

How to get a fire NOC in Daman, Diu or Silvassa, step by step

  1. Check your building against section 29(2)

Above 15 m, or a hotel, resort, eating house, school, assembly, business, shop, factory or store, or apartments or mixed use over 500 m² of all floors added together.

  2. Apply for the provisional NOC before building permission

On the single window or the department's services page choose Provisional NOC, verify your e-mail, fill the form and upload the site plan, proposed plans with area statement and, for industry, raw-material and product details.

  3. Pay after approval and download

The file goes from the dealing hand to the Assistant Director, a Station Fire Officer and the Director. After approval an e-mail brings the payment link for ₹10 per m²; upload the bank receipt and download the signed provisional NOC.

  4. Build with a qualified agency, then apply for the final NOC

Upload the approved plan, the PDA or municipal construction permission, the fire-fighting layout, the agency's compliance certificate and photographs. An inspection committee visits; the single window gives 28 days.

  5. Take the certificate to the PDA, the power and the water offices

Section 29(3) bars an occupancy certificate and electricity or water connections without it; PDA Daman's occupancy checklist asks for the final fire NOC.

  6. Keep it valid

File the maintenance declaration every July and the self-declaration after 30 months; a renewal under the 2025 SOP needs Annexure I, Annexure II, the AMC work order and quarterly service reports.

Section 29(3) in DNH and DD: no power, water or occupancy without it

The clause that gives the Daman, Diu and Silvassa certificate its teeth. It reaches every authority in the UT, not only the fire department.

Word for word

(3) Notwithstanding anything contained in any other law for the time being in force in the Union territory, no authority shall grant or issue electricity or water connections or an occupancy certificate, in respect of any building or premises, unless the owner or occupier thereof has obtained a Fire Safety Certificate in accordance with the provisions of this Regulation: Provided that the owner or occupier of the building referred to in sub-section (2) shall, prior to the grant of building plan approval, obtain a Provisional Fire Safety Certificate, in such form and manner as may be prescribed, and shall, prior to the grant of a completion certificate, obtain a Fire Safety Certificate from the nominated authority.

Dadra and Nagar Haveli and Daman and Diu Fire and Emergency Service Regulation, 2026 (No. 6 of 2026), section 29(3), Gazette of India Extraordinary Part II Section 1, No. 20, 2 June 2026 Gazette of India Extraordinary

Three consequences. The Electricity Department, the PWD water wing and the Planning and Development Authorities are bound by it. The two-stage sequence, provisional before the plan and final before completion, is now statutory rather than an SOP. And because the proviso leaves the provisional certificate's form to rules that had not been notified by 24 October 2026, the 2025 provisional NOC procedure is still the working route.

Flamekite's working of section 29(2) and the 2025 fee SOPs for six premises. The fee is ₹10 per m² of total built-up area, basement included, paid once.

  1. Case 1

A 2,000 m² factory in Dadra and Nagar Haveli

Industrial, 2 floors, total built-up area 2,000 m², no basement.

  2. Case 2

    A 40-room hotel in Daman

Hotel, 3,000 m² above ground plus a 500 m² basement.

  3. Case 3

    A beach resort in Diu

Section 69 lets the Administration make rules after previous publication, and section 69(2)(r) lists what they must cover: the forms, the fee, the self-declaration, the qualified agency's certificate and how agencies are chosen. We found neither a draft nor a notified text, and no order under section 15 naming the premises that need a Fire Safety Officer.

The fee. The ₹10 per m² rate comes from a notification of 9 May 2016 under the repealed Act. Section 74(2) saves such acts if they are consistent with the Regulation, but we could not open the 2016 notification itself.

Validity on the ground. The department's menus still say Annual Renewal and its last published validity order is the 2025 one. We saw no certificate issued after 7 July 2026, so we cannot say what term the portal now prints.

Existing NOCs. Nothing published says whether a final NOC issued in 2025 for 2 years, or 1 year for high-hazard industry, is extended to 5.

The building code. The DNH fire rules on the single window are headed "Draft General Development Rules 2023" and refer to a 2021 draft of the Regulation. They ask for agency certificates every January and July, where the Regulation asks once a year in July. We could not confirm which DNH GDR text is final.

Fire tax and other charges. Section 35 creates a fire tax on top of property tax and section 37 a stand-by fee, but no rate had been prescribed.
