Fire NOC for an industry or MSME: industrial estates, single windows and MSME Acts

Updated By Flamekite Editorial DeskFacts checked against official sources on

Quick answer

MSMEs still need a fire NOC: Punjab and Haryana list it in right-to-business Acts, UP files it with the MSME declaration, RIICO cancels leases after fires.

Six state laws Flamekite read let a new MSME start on a declaration and defer most approvals: 3 years in Rajasthan and Gujarat, 3 years and 6 months in Kerala and Punjab, 1,000 days in Uttar Pradesh and 36 months in Haryana since 18 September 2026. None of these Acts waives fire safety standards, and Haryana's lets the fire authority inspect during the moratorium. Inside an industrial estate the corporation adds its own rules: GIDC hands over plug-and-play sheds with a fire NOC for the whole structure, and RIICO caps buildings at 15 m unless the fire service clears more.

An MSME's fire NOC through an estate or single window in 8 steps

  1. Register on Udyam and fix the hazard class

Udyam is free and self-declared and decides who counts as an MSME; the hazard class of the process decides the fire systems, as the factories page sets out.

  2. Read the estate's own rules first

On a RIICO plot, keep to 15 m unless the fire service clears 18 m, and leave 4.5 m round a building on 4,001 m² or more. In GIDC, check whether you take a shed with a fire NOC or a bare plot.

  3. Choose the MSME route or the regular route

The certificate under the MSME and right-to-business Acts is optional in Punjab and Haryana; a unit may apply for each approval directly at any time.

  4. File on the state single window

In Uttar Pradesh the declaration carries a fire safety application form; in Punjab the statutory fees are paid online with the declaration.

  5. Get the plan-stage fire approval or fire fighting scheme

Haryana's schedule lists a fire fighting scheme for white and green category low-risk industries; elsewhere it is the provisional fire NOC.

  6. Install and audit

In Tripura, a medium or large industry adds a third-party safety audit report to the post-operative application.

  7. Final NOC and occupancy

Expect a joint inspection where the estate runs one: MIDC sends its Fire Department with planning and water officers.

  8. Close every approval before the holiday ends

Haryana wants all pending approvals in the last 6 months of the 36; Uttar Pradesh allows 100 days after the 1,000; Rajasthan and Gujarat 6 months after 3 years.

MSME facilitation Acts and the fire NOC: 6 state laws compared

Each Act lets a new MSME start on a declaration and treats the certificate as every state approval for a period. Their definitions of approval all include a no-objection; only Punjab and Haryana name the fire NOC outright.

  • Uttar Pradesh Act 30 of 2020

1,000 days, with a fire safety form

The declaration of intent carries a fire safety application form, and the District Fire Safety Officer sits on the district committee that meets after 72 hours. The certificate counts as approval for 1,000 days; approvals then follow within 100 days. Crackers and Red category products are excluded. UP Act 30 of 2020

  • Rajasthan Act 14 of 2019

    3 years, Municipalities Act overridden

Approval covers any no-objection under a Rajasthan law, and section 9(2) names the Municipalities Act, 2009, under which the fire NOC is issued. A 2023 Bill to make it 5 years was reported passed on 20 March 2023. Rajasthan Act 14 of 2019

  • Gujarat Act 26 of 2019

3 years, with a fire safety undertaking

The unit signs an undertaking to ensure adequate fire safety. An inspector may still visit within the 3 years once the unit has applied for the permission. Gujarat Act 26 of 2019

  • Kerala Act 16 of 2019

    3 years and 6 months since 2024

Act 26 of 2024 renamed the certificate one of in-principal approval and lengthened it. Larger units go to an Investment Facilitation Bureau with the Director General of Fire and Rescue Services as a member. Kerala Act 16 of 2019

  • Punjab Act 1 of 2020

Fire NOC named in the schedule

Serial 3 of the schedule substituted in October 2025 is the application for a fire NOC under the Punjab Fire and Emergency Service Act, 2024. The certificate runs 3 years and 6 months. Punjab Right to Business Act

  • Haryana Act 28 of 2026

    36 months for low-risk manufacturing

Only Udyam-registered MSME manufacturing units qualify. The Fire Department's fire fighting scheme and NOC for low-risk industries are scheduled approvals. Haryana Act 28 of 2026

Haryana's 2026 Act: the fire safety inspection a moratorium cannot stop

The newest MSME law, in force since 18 September 2026, bars inspections for 36 months but keeps one door open for the fire authority.

Word for word

The Head of the concerned competent authority may suo motu for reasons to be recorded in writing, order an inspection to be conducted in cases of land use violations, unauthorized construction or issues relating to public safety, structural integrity or fire safety.

Haryana Right to Business Act, 2026 (Haryana Act No. 28 of 2026), section 10(2); Haryana Government Gazette Extraordinary, 18 September 2026 Haryana Act 28 of 2026

The older Acts say the same in their savings clauses. Section 10 of Rajasthan's 2019 Act, section 13 of Uttar Pradesh's 2020 Act and section 17 of Punjab's 2020 Act each provide that nothing exempts an enterprise from any law in force or the "regulatory measures and standards" under it, except as the Act expressly says. A certificate defers the paperwork and the routine visit; it does not lower the fire systems the building needs. Haryana's report of such an inspection must reach the unit online within 48 hours.

Which fire route fits your industrial unit: 12 cases

Match your unit to one line. The estate and the state's MSME law decide the route more than the size does.

  1. If A plot in an MIDC industrial area

MIDC's own fire service issues the plan-stage and final approvals; the full route and documents are on the factories page. Fire NOC for Factory MIDC EoDB

  2. If A plug-and-play shed in a GIDC estate

The shed is handed over with a fire department NOC for the whole structure, among 9 pre-approved clearances. GIDC

  7. 7. After a fire

Where negligence or unapproved hazardous stock caused it, the Unit Head starts rule 24(1) proceedings; the lessee gets 45 days to reply. RIICO circular 2026

An estate unit's fire file: 10 items to hold

What the estate rules, the MSME laws and the single windows ask an industrial unit to have ready, beyond the fire NOC itself.

  • The Udyam registration, which Haryana's 2026 Act requires before a unit can seek the certificate. Haryana Act 28 of 2026
  • In Uttar Pradesh, the fire safety application form filed with the declaration of intent. UP Act 30 of 2020
  • In Gujarat, the signed undertaking that the unit will ensure adequate fire safety. Gujarat Act 26 of 2019
  • On a RIICO plot, drawings showing active and passive fire protection to NBC and the fire engine path round the building. RIICO land rules
  • On a RIICO plot of 4,001 m² or more, a clear 4.5 m passage round the building kept free of setback structures. RIICO land rules
  • A fire or explosives NOC for the location and size of any diesel (HSD) storage tank in the setback. RIICO land rules

  • In Tripura, a third-party safety audit report for a medium or large industry at the post-operative stage. Tripura Home (F&ES)
  • In Tripura, a self-certification of non-deviation with the NOC and each renewal. Tripura Home (F&ES)
  • Proof that every regular approval was applied for on the single window inside the moratorium. Haryana Act 28 of 2026

Why an MSME's fire NOC stalls in an estate or single window

Nine traps drawn from the Acts, the estate rules and the single-window sheets.

  • If The unit treats its MSME certificate as a fire clearance and builds without fire systems

The savings clauses keep every regulatory standard in force; design to the fire rules from day 1. Rajasthan Act 14 of 2019

  • If A cracker or Red category unit files under Uttar Pradesh's MSME Act

Section 11 excludes both; take the regular fire NOC route on Nivesh Mitra. UP Act 30 of 2020

  • If A RIICO building is drawn at 20 m

Above 18 m needs the Land Plan Committee, a fire NOC, an 18 m road and the betterment levy; plan for it or stay at 15 m. RIICO land rules

  • If Sheds or stores built in the setback of a large RIICO plot

Plots of 4,001 m² or more must keep 4.5 m clear for fire engines; setback facilities may not obstruct fire tenders. RIICO land rules

  • If A tenant of a GIDC shed assumes the shed's NOC covers any process

The pre-approved NOC is for the whole structure; tell the fire service before bringing in a hazardous process. GIDC

  • If A medium industry in Tripura files the post-operative NOC alone

Annex the third-party safety audit report; the checklist asks for it. Tripura Home (F&ES)

  • If Approvals left until the Haryana moratorium ends

The Act wants all pending approvals in the last 6 months; after that the fire service may act. Haryana Act 28 of 2026

  • If Hazardous stock moved onto a RIICO plot without approval

That is a ground for lease cancellation under the 2026 circular; get the permissions first. RIICO circular 2026

Industrial area fire and approval news, 2023 to 2026

From news reports, not yet an official source.

Press reports, not instruments. They show the direction: more fire stations in estates, tighter estate enforcement and shorter approval clocks.

What Flamekite could not confirm about industrial fire routes

Five estate bodies publish no fire route Flamekite could read on 25 October 2026, and two laws wait on notifications.

Karnataka: the state single window's fire service page failed with an expired security certificate and the fire service site refused the connection, so KIADB's fire rule is not shown. Seva Sindhu's 60-working-day high-rise NOC is the only Karnataka timeline here.

Uttar Pradesh, Uttarakhand and Telangana: UPSIDA's sites returned an error or no response, SIDCUL's did not respond, and the TG-iPASS portal was down. The TS-iPASS Act on India Code returned 403, so its sections on deemed approval and the fire line of Annexure VI were not read. SIPCOT's services page names NOCs but no fire procedure.

Rajasthan: the 2019 MSME Act's definition reaches a no-objection under the Municipalities Act, but Flamekite found no fire service order applying the 3-year holiday to fire NOCs. The 2023 amendment to 5 years was reported passed on 20 March 2023; the amending Act was not read. Uttar Pradesh's MSME Act starts on a notified date that Flamekite did not read.

Haryana and Tamil Nadu: rules under Haryana's 2026 Act were not found, so the forms and fees are open. Tamil Nadu's 21-day cap reaches the 2025 fire Act, which has no commencement notification, and the 1985 Act in force is not in the Schedule.

Questions about fire NOCs for industries and MSMEs

Do MSMEs need a fire NOC?

Yes, wherever the state's fire line catches the building. The MSME laws only defer approvals: Uttar Pradesh for 1,000 days, Rajasthan and Gujarat for 3 years, Punjab and Kerala for 3 years and 6 months, Haryana for 36 months. Punjab and Haryana list the fire NOC as a scheduled approval, and fire safety standards stay in force throughout.

Does Udyam registration replace a fire NOC?

No. Udyam is a free, online, self-declared registration with no documents to upload. It tells the state which enterprises are MSMEs; Haryana's 2026 Act uses it to decide who may seek the certificate. The fire NOC is still issued by the state fire service or local body.

Does an MSME acknowledgement certificate cover the fire NOC?

For a period, in some states. Each Act's approval includes a no-objection, and Punjab's schedule names the fire NOC application. But the savings clauses keep every regulatory standard in force, and the unit must obtain the regular fire NOC before the period ends or within 6 months or 100 days after it.

How do I get a fire NOC in an industrial area?

Through the state single window, unless your estate runs its own fire service as MIDC does. Read the estate's rules first: RIICO caps buildings at 15 m without a fire NOC, and GIDC sheds come with one. Then file the plan-stage fire approval, install, and pass the final inspection.

Is there deemed approval for a fire NOC?

Rarely for the fire NOC itself. Goa says it is not available. Punjab and Haryana deem the MSME certificate issued when a deadline passes, and the DNH and DD single window is a deemed-approval authority. Telangana's rules let the Government notify deemed clearances, but the fire entry was not read.

How long does a fire NOC take through a single window?

From 5 days to 60 working days. Goa promises 5 to 15 days, Gujarat 7 working days, Telangana 7 days up to 15 m, Rajasthan and Uttar Pradesh 15 days, Tripura 28 working days and Karnataka 60 working days for a high-rise NOC. Tamil Nadu's law will cap scheduled clearances at 21 days.

What is third-party certification under BRAP for industry?

BRAP 2024 Reform No. 357 asks states to move low-risk inspections to self-certification and medium-risk ones to accredited third parties. Tripura already asks medium and large industries for a third-party safety audit; Meghalaya told DPIIT in March 2025 it had no such agencies.

Can RIICO cancel my plot after a fire?

Yes, if the fire came from negligence, unauthorised activity, unapproved inflammable or hazardous stock or a lease breach. RIICO's circular of 16 February 2026 orders a show cause notice under rule 24(1), 45 days to reply, then cancellation of allotment and resumption of the plot.
