Fire NOC for a petrol pump: PESO Form XIV, the district NOC, fire rules and fees

Updated By Flamekite Editorial DeskFacts checked against official sources on

Quick answer

A petrol pump needs a PESO Form XIV licence and a district NOC under rule 144 that records fire service comments; Rajasthan and Gujarat add a fire NOC. The NOC comes from the District Magistrate, or the Commissioner of Police in a commissionerate city, and must be decided within 3 months.

Form XIV costs Rs 5,000 a year for each class of fuel up to 50 KL, and runs to 31 December for at most 3 years. Every pump needs 2 extinguishers and 2 drums of dry sand. A new pump stays 50 m from schools, hospitals of 10 beds or more and designated housing, and never under 30 m.

Getting a petrol pump licence and fire NOC in 8 steps

  1. Hold the site and the Letter of Intent

An oil company's Letter of Intent and lawful possession of the land come first; Meghalaya's district SOP asks for both, and PESO wants an undertaking of legal physical possession.

  2. Check the siting before buying

Keep the fill point, dispensers and vent 50 m from schools, hospitals of 10 or more beds and designated housing, and never under 30 m. Jammu and Kashmir adds 300 m between filling stations.

  3. Take the state fire service's view

In Rajasthan and Gujarat a fire NOC is required in its own right; in Meghalaya the fire department's NOC is an enclosure to the district file.

  4. Apply for the rule 144 NOC

File two copies of the site plan with the District Authority. It collects revenue, police, municipal, NHAI or PWD and fire comments, and must decide within 3 months.

  5. Get PESO's prior approval of plans

Form IX with drawings showing protected works within 100 m, tanks, vents, pumps and fire fighting facilities, a CPCB undertaking and the Rs 2,000 scrutiny fee.

  6. Build to the approved plan

Underground tanks in a pit, vent pipes at least 4 m high, a 1.2 m wall on sides other than the drive way, approved Ex electrical apparatus.

  7. Test, certify and get Form XIV

A competent person or TPIA tests the tanks (rule 126) and signs the certificate of safety (rule 130); then the circle office grants the licence.

  8. Diary the renewals

Form XIV runs to 31 December, at most 3 years; file 30 days early. Renew the state fire certificate on its own clock: generally yearly in Rajasthan, every 2 years in Odisha.

Form XIV, rule 144 and the words a petrol pump file uses

The Petroleum Rules use their own words for a petrol pump and the officers around it. These 10 come from the rules, the 2024 amendment and PESO's SOP.

Service station
Premises specially prepared for fuelling motor vehicles, with any servicing places the licensing authority approves; since 2024 also non-fuelling facilities outside the hazardous areas (rule 2(1)(xxiv)). G.S.R. 154(E), 2024

The rule 144 district NOC for a petrol pump: 5 departments comment

The 2024 proforma lists 5 views the District Authority considers before it signs. The fire service's view travels in this file even where the state issues no separate fire NOC.

  1. 1. Revenue Department

Confirms the applicant's lawful possession of the site and the owner's or leaseholder's authority to develop it for petroleum storage. G.S.R. 154(E), 2024

  2. 2. Police

Comments on traffic density and the outlet's impact on traffic. G.S.R. 154(E), 2024

  3. 3. Municipal body or gram panchayat

Comments on conformity with local planning, including schools and hospitals, and any mitigating measures. G.S.R. 154(E), 2024

  4. 4. NHAI or PWD

Comments on road safety, road alignment and access to the road. G.S.R. 154(E), 2024

  5. 5. Fire Department

Comments on the access of fire tenders to the site in an emergency and the fire service's preparedness to combat it. G.S.R. 154(E), 2024

  6. 6. The decision

Within 3 months of the application; a refusal needs written reasons and a hearing, and an appeal lies to the next superior authority within 60 days. Petroleum Rules 2002

CPCB siting rule for new petrol pumps: 50 m, never under 30 m

PESO asks every Form XIV applicant for an undertaking to follow the CPCB guidelines. Their siting paragraph, dated 7 January 2020, is quoted in full by the Kerala High Court.

Word for word

In case of siting criteria for petrol pumps new Retail Outlets shall not be located within a radial distance of 50 meters (from fill point/dispensing units/vent pipe whichever is nearest) from schools, hospitals (10 beds and above) and residential areas designated as per local laws. In case of constraints in providing 50 meters distance, the retail outlet shall implement additional safety measures as prescribed by PESO. In no case the distance between new retail outlet from schools, hospitals (10 beds and above) and residential area designated as per local laws shall be less than 30 meters. No high tension line shall pass over the retail outlet.

CPCB guidelines of 7 January 2020, paragraph H, as extracted in WP(C) No. 12226 of 2025, High Court of Kerala, 18 August 2025 Kerala High Court

The court held that a college is not a school under paragraph H, because CPCB told the National Green Tribunal its expert committee had left colleges out; PESO could not refuse a pump for a college within 30 m. In a 2026 Kerala case reported by LiveLaw, the High Court measured a school's distance from its compound wall, not its building, and upheld a refusal at 25.15 m. Which 'additional safety measures' PESO prescribes between 30 m and 50 m was not found in an official text.

Hazardous zones at a petrol pump: fill point, vent and dispenser

The Fourth Schedule, Part C, sets how far the hazardous area runs around each fitting. Only PESO-approved Ex electrical apparatus may stand inside it (Chapter IV).

ZoneExtent of the hazardous area
Tank filling point Petroleum Rules 2002Zone 1Any pit, sump or box below grade in a zone, and up to 45 cm above grade within 3 m of the fill point
Tank vent, close Petroleum Rules 2002Zone 1Within 90 cm of the open end, in all directions
Tank vent, outer Petroleum Rules 2002Zone 2From 90 cm to 1.5 m of the open end, in all directions
Dispenser cabinet Petroleum Rules 2002Zone 1Inside the cabinet up to 1.2 m above the base, and 45 cm around it
Dispenser, outdoor Petroleum Rules 2002Zone 2From 45 cm to 6 m of the cabinet, up to 45 cm above grade
Lubrication or service room Petroleum Rules 2002Zone 1 in a pit; zone 2The whole pit; up to 45 cm above the floor in the whole room
Sales, storage or rest room Petroleum Rules 2002Zone 1The entire room, if it has any opening within a zone 1 or zone 2 area

Zone 1: vapour is expected in normal operation; zone 2: only on failure, as PESO's SOP describes. Condition 14 of Form XIV bars any light that could ignite vapour within these areas during night fuelling. Two figures in PESO's consolidated text read 'metres' where centimetres are evidently meant; they are left out here.

Where petrol pump approvals fail, and the fix

Most refusals and cancellations turn on who signs, how distance is measured and what was changed after approval. These 7 come from the rules and 3 High Court records.

  • If The District Magistrate signs or cancels the NOC in a police commissionerate city

File with the Commissioner or Deputy Commissioner of Police; the MP High Court quashed an Indore DM's 2022 cancellation for want of jurisdiction. MP High Court

  • If A district authority cancels the NOC after a fire

Rule 150 allows cancellation only where the right to the site ends; safety lapses go to PESO under rule 152, as the MP High Court held. MP High Court

  • If PESO refuses because a college is within 30 m

The CPCB rule names schools, hospitals of 10 or more beds and designated housing; the Kerala High Court set such a refusal aside in 2025. Kerala High Court

  • If A school's distance measured to its building, not its wall

The Kerala High Court treated the school and its compound as one unit in 2026; measure to the compound wall. LiveLawnews report

  • If A drawing that leaves out a neighbouring boundary

PESO told the Kerala High Court an approval was obtained without showing a college wall; show every protected work within 100 m. Kerala High Court

  • If An NOC more than 3 years old when the licence is sought

What Flamekite could not confirm about petrol pump rules

Six questions a petrol pump owner asks that no official text we read on 25 October 2026 answers.

OISD-STD-225 (petroleum retail outlets, October 2010 edition, as OISD listed it on 24 October 2026) could not be read: oisd.gov.in failed with a certificate error on 25 October 2026 and was not bypassed, so no OISD clause is quoted here. We also found no official text of the 'additional safety measures' PESO prescribes for a pump between 30 m and 50 m of a school, and did not read the CPCB guideline PDF itself, only its paragraph H as the Kerala High Court quotes it.

PESO's consolidated text of the Petroleum Rules predates at least one amendment: the 2024 amendment refers to a Form XIV condition 24 that the copy does not print, so a numbered condition here may have moved. Whether Form G's Rs 10,000 is charged once or for each year of the licence is not stated in the Schedule V row we read, and the SMPV fee for an auto-LPG licence after its 2025 amendments was not read; the June 2026 draft Third Amendment to the Gas Cylinders Rules, which touches CNG stations, was not read either.

We found no petrol-pump-specific fire NOC line for Telangana, Karnataka, Delhi, Haryana, Bihar or West Bengal, or Maharashtra beyond Pune, and Punjab's fee schedule after 2021 was not readable. The draft Petroleum (Amendment) Bill, 2026 and draft rules G.S.R. 781(E) of 3 September 2026 are known only from news summaries; what the proposed District Fire Officer would do was not confirmed.

Questions about fire NOCs for petrol pumps

Is a fire NOC mandatory for a petrol pump?

Every petrol pump needs a PESO Form XIV licence and, outside gas stations, the District Authority's rule 144 NOC, which records fire department comments since March 2024. A separate state fire NOC is required in Rajasthan for all pumps, and in Gujarat, Odisha, Jammu and Kashmir, Tripura and Lakshadweep as listed premises.

Who gives the NOC for a petrol pump?

The District Authority under rule 144 of the Petroleum Rules, 2002: the Commissioner or a Deputy Commissioner of Police in a commissionerate town, the District Magistrate or an Additional District Magistrate elsewhere. It must decide within 3 months, and PESO accepts the NOC for 3 years.

How much is the PESO licence fee for a petrol pump?

Form XIV costs Rs 5,000 a year for each class of petroleum up to 50 KL, plus Rs 50 for every further KL, capped at Rs 50,000 a year per class (Part A of the First Schedule since 10 August 2018). Plan approval is Rs 2,000, and a late renewal costs twice the fee.

How far must a petrol pump be from a school?

Under CPCB's guidelines of 7 January 2020, a new outlet's fill point, dispensers and vent should be 50 m from schools, hospitals of 10 or more beds and designated residential areas; with PESO's added safety measures it may be closer, but never under 30 m. Kerala's High Court measures to the school's compound wall.

How many fire extinguishers does a petrol pump need?

Form XIV condition 20 asks for at least 2 foam or dry chemical extinguishers and 2 tins or drums of dry sand for each pump. A CNG station adds a 10 kg DCP at each dispenser, compressor and cascade area, and a 4.5 kg CO2 per 25 m² of electrical room.

How long is a petrol pump licence valid?

A Form XIV licence runs to 31 December of the year it is granted or renewed for, at most 3 years. Apply at least 30 days before expiry to keep it in force; within 30 days after expiry it costs twice the fee, and later it cannot be renewed.

Does a CNG station need a district NOC?

No, since 5 June 2026: G.S.R. 447(E) omitted rule 48 of the Gas Cylinders Rules. A Form XIV licence inside a CNG, auto-LPG or LNG station has needed no rule 144 NOC since 4 March 2024. State fire rules still apply.

Can the district cancel a petrol pump NOC after a fire?

Under rule 150 the District Authority or State Government may cancel the NOC only if the licensee loses the right to use the site. The MP High Court quashed a 2022 cancellation made after a fire; safety breaches are for PESO, which can suspend for up to 3 months or cancel.
