Fire NOC in Sikkim: the Fire Safety Certificate under the 2025 Rules

Updated By Flamekite Editorial DeskFacts checked against official sources on

Quick answer

In Sikkim the fire NOC is a Fire Safety Certificate from Sikkim Fire and Emergency Services. Section 24(3) of the Sikkim Fire and Emergency Services Act, 2023 requires one for buildings over 15 m from the plinth, for educational, institutional, assembly, business, mercantile, industrial, storage and hazardous buildings, and for mixed occupancies over 500 m².

The Sikkim Fire and Emergency Services Rules, 2025, in force since 17 December 2025, set the paperwork: Form A9 online, a licensed third-party agency's certificate for larger buildings, and a term of 5 years for homes, 3 for other non-residential buildings and 1 year for hotels, hospitals, assembly, storage and industrial buildings. Renewal is due a month before expiry. No certificate fee is published.

How to get a Fire Safety Certificate in Sikkim, step by step

  1. Check section 24(3) and rule 28

Measure the height from the plinth and the floor and basement areas. Over 15 m, or any educational, institutional, assembly, business, mercantile, industrial, storage or hazardous use, needs a certificate; rule 28 says which smaller buildings skip the agency certificate.

  2. Fit the measures with a qualified agency

Section 24(6) lets only qualified agencies install fire prevention and life safety measures, to Part IV of the National Building Code and the 21 heads in rule 26.

  3. Get the third-party agency certificate

If rule 28 does not exempt the building, a licensed Qualified Third Party Agency inspects and certifies compliance on Form A2.

  4. Appoint a Fire Safety Officer where Schedule V says so

Hotels of 50 rooms or more, 4-star hotels, non-residential buildings of 24 m and more and 16 other classes need one; report on Form A6 to the In-charge Fire District.

  5. File Form A9 online

Attach the checklist, the agency certificate, the Fire Safety Officer's letter, the electrical and lift safety certificates and the last certificate, with maps and drawings. Only the owner or an authorised representative may pursue it.

  6. Host the inspection

An Assistant Sub-Fire Officer or above inspects smaller buildings; the In-charge Fire District or Fire Region inspects agency-certified ones, judging actual height, area, hazard and occupancy, not only the sanctioned map.

  7. Receive Form A10 or A11 and display it

A provisional certificate comes on Form A10, a final one on Form A11. Frame copies in corridors, lobbies and on every floor (rule 34).

  8. Declare in January and July, renew a month early

File Form A6 every January and July, and apply on Form A-11 one month before the 5, 3 or 1-year term ends.

Rule 30 of Sikkim's 2025 fire rules on how long a certificate lasts

One sentence of the 2025 Rules sets the term of every Sikkim Fire Safety Certificate, provisional, final and renewed alike.

Word for word

30. The Provisional, Final and Renewal of Fire Safety Certificate issued under rule 29, unless sooner cancelled, shall be valid for a period of 5 years for residential buildings (other than hotels) and for a period of 3 years for non-residential buildings except hotels, hospitals, assembly, storage, industrial and all other occupancies including those requiring certificate from Qualified Third Party Agency which shall have the validity of one year from the date of issue.

Rule 30, Sikkim Fire and Emergency Services Rules, 2025, Home Department notification No. 99/Home/2025, Sikkim Government Gazette Extraordinary No. 466, 17 December 2025 (read against the page image) Sikkim F&ES Rules 2025

Read plainly, a block of flats gets 5 years, an office or a shop 3 years, and a hotel, hospital, hall, godown or factory 1 year. The words "and all other occupancies including those requiring certificate from Qualified Third Party Agency" can also be read to put every agency-certified building on a 1-year term, so a large office may get 1 year, not 3. A proviso lets the State Government shorten or lengthen any term by order. The Act itself sets no term; the Flamekite validity page still says no rules were found and needs this update.

Sikkim buildings that need no third-party agency certificate under rule 28

Rule 28 lists 6 classes of permanent building that can apply without a Qualified Third Party Agency's certificate. The list is not exhaustive, and the Government may revise it.

Height lineArea line
1. Residential, hotels excluded Sikkim F&ES Rules 2025Below 15 mOr a single basement under 500 m²
2. Educational Sikkim F&ES Rules 2025Below 15 mAnd floor area under 500 m²
3. Institutional (nursing homes, hospitals) Sikkim F&ES Rules 2025Below 15 mAnd plot area under 500 m²
4. Business (offices, banks, labs, data centres) Sikkim F&ES Rules 2025Below 15 mFloor area under 500 m² and a single basement under 500 m²
5. Mercantile (shops, markets, stores) Sikkim F&ES Rules 2025Below 15 mFloor area under 500 m² and a single basement under 500 m²
6. Any occupancy Sikkim F&ES Rules 2025AnyWhere the codes require only fire extinguishers

Read against the page images of rule 28. Hotels, assembly halls, godowns and factories are not in the table, so they need the agency's Form A2 certificate whatever their size. Schedule IV then sends these exempt buildings to the In-charge Fire Station for issue, and all others to the Chief Fire Officer or the Director.

Does your Gangtok hotel, Pelling homestay or Namchi shop need a Fire Safety Certificate?

Find the line closest to your building. Section 24(3) of the Act decides whether you need a certificate; the 2025 Rules decide how.

  1. If Any building more than 15 m high from the plinth

Yes: section 24(3)(i) names multistoried buildings over 15 m, homes included. Sikkim Gazette 226

  2. If A hotel, lodge or guest house in Gangtok, Pelling or Lachung

Hotels are not in the rule 28 exemptions, and Tourism's Form II asks for a Fire NOC. The certificate runs 1 year under rule 30. Sikkim Tourist Trade Rules

  3. If A hotel of 50 rooms or more, or 4-star and above

Schedule V also requires a Fire Safety Officer with staff for round-the-clock cover. Sikkim F&ES Rules 2025

  4. If A homestay of 1 to 5 rooms in the owner's village house

The Tourism homestay form lists no fire NOC, and a home under 15 m is not a section 24(3) class. Flamekite found no Sikkim text requiring one. Sikkim Tourist Trade Rules

  5. If A shop, showroom or office of any size

Mercantile and business buildings are special buildings under section 24(3)(ii); under 15 m and 500 m² they skip the agency certificate. Sikkim Gazette 226

  6. If A school, college or coaching building

Educational buildings are a section 24(3) class at any height; a 15 m school or one with over 2,000 students also needs a Fire Safety Officer. Sikkim F&ES Rules 2025

  7. If A pandal, shamiyana or tent for a festival

No certificate: the organiser files a Form A15 declaration with a layout plan 24 hours before the event. Do I need a fire NOC? Sikkim F&ES Rules 2025

  8. If Premises that already hold a certificate

Renew on Form A-11 one month before the end date printed on it. Validity, all states Sikkim F&ES Rules 2025

The 21 fire measures rule 26 can require in a Sikkim building

Rule 26(1) sets these minimums in addition to the bye-laws and codes. Its proviso says not every building needs all 21: the Fire Officer judges by covered area, height and occupancy.

Who signs a Sikkim Fire Safety Certificate: station, district or Director

Schedule IV of the 2025 Rules splits every application into 2 tracks, and rules 6 and 11 set the offices behind them.

  1. 1. The owner, online

Files Form A9 with the maps, drawings and certificates; nobody but the owner or an authorised representative may pursue it. Sikkim F&ES Rules 2025

  2. 2. Track A: buildings exempt under rule 28

Inspected by an Assistant Sub-Fire Officer or above, and the certificate is issued by the In-charge Fire Station. Sikkim F&ES Rules 2025

  3. 3. Track B: agency-certified buildings

Inspected by the In-charge Fire District or Fire Region or a higher officer, and issued by the Chief Fire Officer or the Director. Sikkim F&ES Rules 2025

  4. 4. The 6 fire districts

Gangtok, Mangan, Namchi, Pakyong, Gyalshing and Soreng, each headed by an officer not below Deputy Chief Fire Officer. Sikkim F&ES Rules 2025

  5. 5. The 3 fire regions

Gangtok (with Mangan), Namchi (with Pakyong) and Gyalshing (with Soreng), each under an Additional Chief Fire Officer or above. Sikkim F&ES Rules 2025

  6. 6. The Director

An officer not below Inspector General of Police, working under the Director General of Police. Sikkim Gazette 226

  7. 7. One month

Section 25 gives the Fire Officer a month from an application that carries all documents, designs, maps and completion certificates. Sikkim Gazette 226

Worked Sikkim cases from MG Marg, Gangtok to a Rangpo factory

Flamekite’s working from the official rules; no government publishes this figure.

Flamekite's reading of section 24(3), rules 28 and 30 and Schedule V for 6 premises.

  1. Case 1

A 40-room hotel near MG Marg, Gangtok

    Ground plus 5, about 19 m, 40 rooms, 3-star.

What applies Over 15 m and a hotel: a certificate with a Qualified Third Party Agency's Form A2, issued by the Chief Fire Officer or Director, renewed every year. Under 50 rooms and below 4-star, so no Fire Safety Officer under Schedule V. Sikkim F&ES Rules 2025

  2. Case 2

    A 4-room homestay near Pelling

Owner's 2-storey village house in Gyalshing district, 4 rooms with attached toilets.

What applies Within the 5-room homestay cap, registered on Form IV with no fire NOC on the list. Under 15 m and residential, so not a section 24(3) class on Flamekite's reading. Sikkim Tourist Trade Rules

  3. Case 3

A 3-storey shop in Namchi bazaar

Mercantile, about 10 m, 400 m² of floor, no basement.

What applies Mercantile buildings need a certificate at any size, but under 15 m and 500 m² it skips the agency certificate and the In-charge Fire Station issues it, for 3 years. Sikkim F&ES Rules 2025

  4. Case 4

A 2,000 m² pharma unit near Rangpo

    Industrial, moderate hazard, single storey.

What applies Industrial: a certificate with an agency's Form A2, a 1-year term, and a Fire Safety Officer because moderate-hazard industry over 300 m² is in Schedule V. Sikkim F&ES Rules 2025

  5. Case 5

    A 16 m apartment block in Tadong

Residential, ground plus 5, 20 flats.

What applies Over 15 m, so section 24(3)(i) applies; rule 28 exempts homes only below 15 m, so an agency certificate is needed. Residential buildings other than hotels get 5 years. Sikkim F&ES Rules 2025

  6. Case 6

A Durga Puja pandal in Gangtok

    Temporary shamiyana for 5 days.

What applies Built to IS 8758:1993; the organiser files Form A15 with a layout plan with the In-charge Fire District 24 hours before, and any shortcoming must be fixed within 4 hours of a notice. Sikkim F&ES Rules 2025

Sikkim fire certificate mistakes that cost a hotel its season

Seven traps in the 2025 Rules and the tourism and building texts, each with the fix.

  • If Diarying a hotel certificate for 3 years

Rule 30 gives hotels, hospitals, assembly, storage and industrial buildings 1 year. Read the term printed on Form A11. Sikkim F&ES Rules 2025

  • If Filing the renewal in the last week

Rule 31 asks for the Form A-11 renewal one month before expiry, with all documents. Sikkim F&ES Rules 2025

  • If Hiring an installer who is not licensed

Only qualified agencies may install measures (section 24(6)), and the agency certificate must come from an agency licensed on Form A4. Sikkim Gazette 226

  • If Sending a middleman to chase the file

Rule 29(1) allows only the owner or an authorised representative; a canvasser is punishable under section 35. Sikkim F&ES Rules 2025

  • If Relying on the sanctioned map

Officers assess the actual covered area, height, hazard and occupancy (rule 29(8)); a floor added after the blue print counts. Sikkim F&ES Rules 2025

  • If Letting a homestay grow past 5 rooms

The homestay cap is 5 rooms; beyond it the unit registers as a hotel on Form II, whose list includes a Fire NOC. Sikkim Tourist Trade Rules

  • If Missing the January or July declaration

Rule 41 wants Form A6 every January and July; shortcomings found then must be fixed within the notice period, at most 30 days. Sikkim F&ES Rules 2025
