Fire NOC in Delhi: the DFS fire safety certificate explained

Updated By Flamekite Editorial DeskFacts checked against official sources on

Quick answer

In Delhi the fire NOC is the Fire Safety Certificate (FSC) issued by the Delhi Fire Service under the Delhi Fire Service Act, 2007 and Rules, 2010. Until 20 May 2027 it is valid 5 years for residential buildings other than hotels and 3 years for every other building, hotels included.

The new regime, in which the certificate stays valid until cancelled provided an online Form K is filed every year with ₹1,000, was gazetted on 26 May 2026 but deferred by a Delhi Gazette notification of 16 October 2026. It is due to start on 20 May 2027.

How to get a fire NOC in Delhi, step by step

  1. Test your building against Rule 27

Compare its height, storeys and floor area with the Rule 27 triggers for its occupancy. Mezzanine and stilt floors count as storeys under the amended Rule 27, so a stilt plus 4 floors is 5 storeys. The Supreme Court (Vikas Singh, 2022) read the earlier wording as leaving a house of up to 17.5 m with stilt parking outside the high-rise line, so ask DFS in writing for a stilt plus 4 house of 15 to 17.5 m.

  2. File plans through the sanctioning body

Submit building plans to MCD, DDA, NDMC, the Cantonment Board or DUSIB, which route them to DFS. A building over 15 m may be asked for a 3D model at this stage.

  3. Get the DFS fire safety recommendations

DFS issues fire safety recommendations on the plans. They stay valid as long as the approved plan is not altered, so any revision goes back to DFS.

  4. Build and install what the recommendations list

Fit the extinguishers, hose reels, risers, sprinklers, alarms, tanks and pumps the recommendations name. Nursing homes also follow the DFS sheet dated 23 January 2025.

  5. Apply for the certificate before anyone moves in

Ask DFS to inspect the finished building and issue the Fire Safety Certificate. If DFS finds gaps, read them on its shortcomings lookup and fix them before asking again.

  6. Renew 6 months ahead, or file Form K after 20 May 2027

Renew on Form I through the DFS renewal portal at least 6 months before the 5 or 3 year term ends. From 20 May 2027 the yearly Form K with ₹1,000 replaces the renewal.

What Delhi's 16 October 2026 gazette notification says

One sentence moved the start of Delhi's new certificate regime by 270 days, from 24 August 2026 to 20 May 2027.

Word for word

In exercise of the powers conferred by Section 63 of the Delhi Fire Service Act, 2007 (Delhi Act 2 of 2009), the Lieutenant Governor of the National Capital Territory of Delhi hereby extends the period of commencement of Rules 34, 35, 36, 37 38, the First Schedule and Seventh Schedule under Delhi Fire Service (Amendment) Rules, 2025, for a further period of 270 days with effect from 24/08/2026 i.e. upto 20/05/2027.

The rules it holds back are the ones that matter to owners: the valid-until-cancelled Rule 36, the ₹1,000 Form K fee in Rule 38(2), continuous monitoring in Rule 37 and the auditor empanelment in the Seventh Schedule. The rest of the 26 May 2026 amendment, including the revised Rule 27 thresholds, took effect on publication.

Which Delhi buildings need a fire NOC under Rule 27

Rule 27, as amended on 26 May 2026, lists the buildings that need a DFS certificate. Crossing any one trigger is enough.

Height triggerStorey triggerArea or other trigger
Residential, other than hotels and guest houses DFSOver 15 m5 or more storeysNone listed

Mezzanine and stilt floors are counted as storeys. The DFS FAQ written before the amendment gives the same limits as ground plus upper storeys.

Is a DFS fire NOC mandatory for your Delhi building?

Find the line that describes your premises. Each one says which DFS route applies.

  1. If Your building crosses a Rule 27 trigger, such as a 16 m office block

You need DFS fire safety recommendations at plan stage and a Fire Safety Certificate before occupation. DFS

  2. If You run a restaurant, guest house, banquet hall or amusement park

Your establishment licence sits outside the DFS renewal portal: DFS still links the MHA eating and lodging portal, though the LG's order of 19 June 2025 reportedly moved licensing from the Delhi Police to the local bodies, so confirm with your local body. The building itself still meets Rule 27. DFS

  3. If You are putting up a pandal for more than 50 people or over 50 m²

Rule 27 covers it, and Rule 29 sets its fire standards by IS 8758:1993 and NBC 2005. Delhi Fire Service

  4. If You run a nursing home of ground plus 2 storeys or more, under 15 m

The DFS nursing-home sheet applies: a 6 m access road, 2 staircases, sprinklers and an underground tank. DFS

  5. If Your home is 15 m or lower and has 4 storeys or fewer

Rule 27 does not list it, but the building bye-laws your sanctioning body applies still set fire measures. DFS

  6. If Your certificate expires before 20 May 2027

Renew it under the current Rule 36 on Form I, at least 6 months before expiry. Do not wait for Form K. DFS

The five Delhi instruments behind a fire NOC

Two are in force in full, one is in force in part, and two had no confirmed start date on 24 October 2026.

Sets up DFS, the Fire Safety Officer duty in section 29 and the penalties in sections 31 to 54. Section 63 is the rule-making power used for the 2026 amendment and its deferral. Delhi Gazette

  • In force 2 July 2010

    Delhi Fire Service Rules, 2010

Rule 27 lists the buildings covered, Rule 33(1) sets minimum standards by the bye-laws or NBC 2005, and Rule 36 fixes the 5 and 3 year validity. Delhi Fire Service

  • Gazetted 26 May 2026

Delhi Fire Service (Amendment) Rules, 2025

How Delhi's third-party Fire Safety Auditor regime will work

The Seventh Schedule that creates it is deferred with Rules 34 to 38, so none of this is in force before 20 May 2027.

  1. 1. Auditor applies on Form U

An individual, association or company applies online to the DFS Director. Empanelment lasts 3 years. DFS

  2. 2. DFS places the auditor at a level

There are 3 levels. Level L-1 covers Rule 27(3) and 27(4) buildings under 15 m and needs a BE (Fire), or a graduate with the NFSC Nagpur Sub-Officer course or GIFireE, plus 1 year of experience. DFS

  3. 3. Auditor buys indemnity cover

Professional indemnity insurance of ₹10 lakh at L-1, ₹20 lakh at L-2 and ₹30 lakh at L-3. DFS

  4. 4. Owner picks an auditor

The building owner chooses an empanelled auditor from the list on the DFS portal. DFS

  5. 5. Auditor issues or keeps the certificate

An auditor may issue the Fire Safety Certificate, and may file the yearly Form K before the 12 months since issue or the last Form K run out. DFS

  6. 6. Systems report continuously

The new Rule 37 makes an Automated Continuous Monitoring System mandatory, so fire systems are watched between yearly filings. DFS

DFS online portals for Delhi fire NOC

Delhi has no single fire NOC portal: plans go through the sanctioning body, and renewals through a DFS portal built by NIC.

Delhi restaurants, hotels and nursing homes: worked cases

Flamekite’s working from the official rules; no government publishes this figure.

Five common Delhi premises, run through Rule 27 and the DFS pages. Your own building may differ.

  1. Case 1

    A 4-storey guest house, 13 m

Rooms on 4 floors, 13 m high, in a residential colony.

What applies Covered: hotels and guest houses cross the line above 12 m or at 4 storeys. Its certificate runs 3 years, as hotels count as non-residential, and its lodging licence goes through the MHA and Delhi Police portal. DFS

  2. Case 2

    A restaurant on 2 floors

A dining hall seating guests on the ground and first floors.

What applies Rule 27 covers every assembly building at any height, so if DFS classes it as assembly it needs a certificate. Its eating-house licence is outside the DFS renewal portal. DFS

  3. Case 3

An apartment block, stilt plus 5 floors, 18 m

Flats on 5 floors over stilt parking.

What applies Covered twice over: above 15 m, and 6 storeys once the stilt counts. As residential it renews every 5 years until 20 May 2027, and may be asked for a 3D model at plan stage. DFS

  4. Case 4

    A ground plus 2 nursing home, 11 m

    Beds on 3 floors, under 15 m.

What applies Likely covered, as institutional buildings cross the line at 3 storeys. The DFS nursing-home sheet asks for 2 staircases, a 2.0 m main stair, sprinklers, a 75,000 to 1,50,000 litre underground tank and 1,620 L/min pumps. DFS

  5. Case 5

    A single-floor warehouse of 300 m²

One storey of storage, 300 m² covered area.

What applies Covered: storage crosses the line above 250 m² of covered area, whatever its height. DFS

Delhi fire NOC mistakes that lead to refusal or sealing

Most Delhi problems come from reading the 2026 amendment as already in force, or from the wrong portal.

  • If Treating a Delhi certificate as valid until cancelled today

That rule is deferred to 20 May 2027. Renew on the 5 or 3 year cycle until then. Delhi Gazette

  • If Applying for renewal in the last few weeks

File Form I at least 6 months before the certificate ends. DFS

  • If Leaving the stilt or mezzanine out of the storey count

Both count as storeys under the amended Rule 27, which can push a 4-floor building over the 5-storey line; for a stilt plus 4 house up to 17.5 m, the Supreme Court's 2022 Vikas Singh reading of the old wording differs, so get DFS's view in writing. DFS

  • If Renewing a guest house, banquet hall or restaurant on the DFS renewal portal

Those establishments are outside it. DFS still links the MHA eating and lodging portal, but licensing reportedly moved from the Delhi Police to the local bodies in June 2025: check with your local body. DFS

  • If Reading the NBCS 2026 high-rise line of 24 m as relief for Delhi

Delhi's Rules name NBC 2005 and set their own 15 m residential trigger. Delhi Fire Service

  • If Ignoring a deficiency letter

Check the DFS shortcomings lookup and fix each item before asking for a fresh inspection. DFS

  • If Skipping the Fire Safety Officer a listed building must appoint

Section 31(2) levies ₹10 to ₹50 per m² for every month without one. Caseminestudy

Documents and records to keep ready for DFS

DFS does not publish one document list on the pages Flamekite read; these are the papers its rules and pages refer to.

  • Building plans sanctioned by MCD, DDA, NDMC, the Cantonment Board or DUSIB DFS
  • The DFS fire safety recommendations letter issued on those plans DFS
  • A 3D model of the building, if it is over 15 m and DFS asks for one DFS

What Delhi owners should do before 20 May 2027

Do

  • Diary your certificate's 5 or 3 year end date and file renewal 6 months before it. DFS
  • Check the Delhi Gazette again in May 2027: the Form K start has been moved once, by 270 days. Delhi Gazette
  • Plan for a yearly ₹1,000 Form K and a continuous monitoring system from 2027. DFS

Don’t

  • Don't let a certificate lapse in 2026 or early 2027 expecting the new rule to save it. Delhi Gazette
  • Don't hire a Fire Safety Auditor to issue your certificate yet; the Seventh Schedule is not in force. Delhi Gazette
  • Don't alter an approved plan without going back to DFS: the recommendations hold only for the plan they were given on. DFS

What Flamekite could not confirm about Delhi fire NOC

Six points about the Delhi regime that no official source we read settles, as of 24 October 2026.

The certificate fee under the current Rule 38. The only fee in the rules we read is the ₹1,000 in the amended Rule 38, which starts on 20 May 2027. The DFS pages we read on 24 October 2026 show no fee schedule for a certificate or a renewal today.

A statutory decision time. We found no Right to Service timeline for a DFS certificate. The 30-day single-window turnaround in The CSR Journal is reported as a proposal, not a rule.

When the Delhi Fire Service (Amendment) Act, 2026 starts. It was assented on 25 August 2026 and starts on a date to be notified; we found no such notification. Whether its removal of the National Building Code from section 2(i) changes how Rule 33(1) still names NBC 2005 is not settled.

Whether the Amendment Rules, 2026 reported by IANS on 29 August 2026 are a separate instrument from the 26 May 2026 amendment. A search summary says they start only when DDA notifies the amended Unified Building Bye-Laws 2016; we have not read their text.

The jail term for breaking a seal under section 44, which is not legible in the copy we read. Penalty amounts on this page come from a secondary copy of the 2007 Act.

A further deferral. The 20 May 2027 date is the one in force on 24 October 2026; Flamekite will re-check the Delhi Gazette before it.
