Fire NOC for an apartment building: state lines, the builder's and the residents' duties, and fees
Updated By Flamekite Editorial DeskFacts checked against official sources on
Quick answer
An apartment building needs a fire NOC once it crosses your state's line: flats from 9 m and over 250 m² in Rajasthan, more than 8 flats in West Bengal, 15 m in most states, 16.5 m in Haryana, 21 m in Karnataka and, since 7 October 2026, 24 m for residential apartments in Telangana. The codes class flats as A-4 (NBC 2016) or A-III (NBCS 2026).
The builder takes the provisional and final NOC before the occupancy certificate; after handover the owners maintain the systems and file the state's periodic certificate, such as Maharashtra's Form B every January and July. The RERA Act makes the promoter list fire fighting facilities when registering and hand the plans to the association within 30 days of the occupancy certificate where no local law sets a time.

An apartment project's fire NOC from plan to handover in 7 steps
Class the building and test it against the state line
Record it as A-4 (NBC 2016) or A-III (NBCS 2026) and measure it the way your state does: Delhi counts the stilt as a storey, Andhra Pradesh counts it in the 24 m, Assam and West Bengal count flats.
Take the plan-stage fire approval
Telangana's Provisional NOC comes before plan approval; Maharashtra's Provisional approval comes at plan stage; Bihar asks a 15% bank guarantee on the fire-system estimate, held 5 years.
Disclose the fire facilities to RERA
Register the project with its development plan, which must list the fire fighting facilities and emergency evacuation services, and keep the approvals list on the RERA page current every quarter.
Install through a licensed agency
Fit the systems the height band asks for: in Maharashtra extinguishers, a hose reel and a 5,000 litre terrace tank even below 15 m; a down-comer from 15 m; a wet riser above 35 m.
Get the final NOC before the occupancy certificate
Haryana will not issue an occupation certificate without the Fire Safety Certificate; Rajasthan wants the permanent NOC first; Mumbai asks for PWD lift certificates at 24 m and above.
Hand the fire papers to the association
Under RERA section 17(2), the documents and plans go to the association as local law sets, or within 30 days of the occupancy certificate where it sets none.
Diary the owners' periodic filing
Form B each January and July in Maharashtra, Form A-8 in Uttar Pradesh, the January audit upload in Telangana above 30 m, the 5-year renewal in Delhi until 20 May 2027.
Apartment, flat and group housing: the words in the codes and Acts
Which word your state uses decides which row a fire officer reads. These 9 terms come from the 2 codes, 4 state instruments and the RERA Act.
- A-4 Apartment houses (NBC 2016)
- Living quarters for 3 or more families living independently of each other, each with independent cooking; apartments, mansions and chawls are the code's examples. BIS, NBC 2016 Part 4

- Real estate project (RERA, s.2(zn))
- The building of apartments, or the conversion of a building into apartments, for sale, including the common areas and development works. RERA Act 2016
RERA section 4(2)(e): fire fighting facilities in every registered apartment project
The RERA Act does not issue a fire NOC, but it makes the promoter put the fire facilities on record at registration, where buyers can read them.
Word for word
(e) the plan of development works to be executed in the proposed project and the proposed facilities to be provided thereof including fire fighting facilities, drinking water facilities, emergency evacuation services, use of renewable energy;
Clause (c) of the same sub-section asks for an authenticated copy of the approvals and commencement certificate from the competent authority, phase by phase, and clause (d) for the sanctioned plan and specifications. After registration, section 11(1)(d) makes the promoter post on the Authority's website, every quarter, "the list of approvals taken and the approvals which are pending subsequent to commencement certificate". A final fire NOC usually comes near completion, so a buyer should expect to see it on that list as pending until then. Registration is needed for projects over 500 m² of land or more than 8 apartments, all phases counted (section 3(2)(a)).
Handing an apartment's fire papers from builder to association: 8 stops
The RERA Act sets the order in which the promoter's fire duties pass to the buyers. Where a state's local law sets its own time, that time applies; the figures below are the Act's fall-backs.
1. Association formed
The promoter enables an association or society of allottees; absent local law, within 3 months of a majority booking (s.11(4)(e)). Every allottee shall take part in forming it (s.19(9)). RERA Act 2016
2. Final fire NOC, then occupancy certificate
The promoter obtains the completion or occupancy certificate and makes it available to allottees or the association (s.11(4)(b)). In Haryana the occupation certificate cannot issue before the Fire Safety Certificate. Government of Haryana
3. Essential services until takeover
The promoter provides and maintains essential services, on reasonable charges, until the association takes over maintenance (s.11(4)(d)). RERA Act 2016
4. Possession within 2 months
Every allottee takes physical possession within 2 months of the occupancy certificate (s.19(10)). RERA Act 2016
5. Conveyance within 3 months
Absent local law, the conveyance deed and the common areas pass to the association within 3 months of the occupancy certificate (s.17(1)). RERA Act 2016
6. Documents and plans within 30 days
Absent local law, the necessary documents and plans, including the common areas, go to the association within 30 days of the occupancy certificate (s.17(2)). Ask that the fire NOCs and system drawings are in the bundle. RERA Act 2016
7. Insurance papers
On the association's formation, all documents of the title and construction insurance the promoter took go to the association (s.16(4)). RERA Act 2016
8. 5 years of defect liability
A structural defect or a defect in workmanship, quality or provision of services reported within 5 years of possession is put right by the promoter within 30 days at no charge (s.14(3)). RERA Act 2016
Buying a flat: 12 fire checks before you pay
Each check rests on an official text a buyer can point to. None of them replaces the fire service's own record of the building.
- The project's RERA registration number appears in the advertisement with the Authority's website (s.11(2)); projects over 500 m² or 8 flats must register. RERA Act 2016
- The RERA page lists fire fighting facilities and emergency evacuation services in the development plan (s.4(2)(e)). RERA Act 2016
- The quarterly approvals list shows the fire NOC as taken or pending (s.11(1)(d)), and the sanctioned plans are on display at booking (s.11(3)(a)). RERA Act 2016
- The building's height and flat count against your state's row in the table above: 24 m in Telangana, 21 m in Karnataka, more than 8 flats in West Bengal. TGFD circular 3455

- In Maharashtra, the society can show its last Form B, filed every January and July; there is no routine renewal to ask for. MFS circular 64
- In a Mumbai tower of 24 m or more, the Final approval file carried PWD lift certificates. Mumbai Fire Brigade

What Flamekite could not confirm about apartment fire NOCs
These 9 points were checked and left open on 25 October 2026. Where they matter to your building, ask the fire service in writing.
No state publishes how many apartment buildings hold a valid fire NOC, so no figure for compliance appears here beyond what officials told reporters.
- NBCS 2026 Table 7A: how a 24 to 60 m apartment tower is graded when its area falls in a lower band, and whether the area is per floor or in all.
- Karnataka: the Act's 21 m line against Seva Sindhu's "above 15 m" listing; KSFES has not published which governs a 15 to 21 m block.
- Andhra Pradesh: whether the 2018 MA&UD circular's 18 m still applies to apartments now that section 13(1) uses 24 m.
- Telangana: what a residential block of 18 m to 24 m approved before 7 October 2026 owes at renewal, and why the 2020 audit circular names no tier for apartments of 18 m to 30 m.
- A height at which NBCS 2026 itself makes a fireman's lift compulsory in apartments: Flamekite read the definition, not a trigger.
- State RERA rules and regulations that may require a fire NOC upload: only the central Act was read for this page.
- Maharashtra model bye-law 75(c) ties the society's fire audit to a "State Fire Policy" that no instrument defines.
- The outcome of the inquiry into the 22 January 2022 Tardeo fire: no published report was found.
- A Press Information Bureau release of March 2026 on a Delhi residential fire returned HTTP 403 and was not read.
Questions about fire NOCs for apartments and flats
Is a fire NOC mandatory for an apartment?
- Yes, once the block crosses your state's line. Most states use 15 m; Delhi over 15 m or 5 storeys, Haryana above 16.5 m, Karnataka 21 m and Telangana 24 m for residential apartments since 7 October 2026. Some count flats: more than 8 in West Bengal, 10 in Assam.
Who applies for the fire NOC of an apartment, the builder or the residents?
- The builder or promoter takes the provisional and final NOC before the occupancy certificate. After handover the owners or their association maintain the systems and file the periodic certificate, as Bihar's rule 22(h) and Maharashtra's Form B make plain.
What is the fire NOC height for apartments in Hyderabad?
- 24 m and above, for fresh Provisional NOC applications received on or after 7 October 2026, under circular Rc.No.3455/MSB/2026. It was 18 m before. The change covers residential apartments only.
Does an apartment in Bangalore need a fire NOC?
- At 21 m or more under section 13(3) of the Karnataka Fire Force Act as amended in 2023, though Seva Sindhu still lists above 15 m. The residential fee is Rs 35 per m² of built-up area, minimum Rs 2,50,000.
How can I check whether an apartment has a fire NOC?
- Ask for the certificate number and check it on the state portal where one exists: Uttar Pradesh by NOC ID, Kerala by application number, Gujarat by building name, DNH and DD by barcode. Then read the project's RERA page, which lists approvals taken and pending every quarter.
Does RERA require the fire NOC?
- The RERA Act asks the promoter to list fire fighting facilities and emergency evacuation services at registration (s.4(2)(e)), to post approvals taken and pending each quarter (s.11(1)(d)) and to obtain the occupancy certificate (s.11(4)(b)). The fire NOC itself comes from the state fire service.
Do apartments need a refuge area?
- Under NBCS 2026, not if every flat has a balcony; otherwise refuge spaces in the shaft lobby or refuge areas above 24 m. Rajasthan exempts buildings where every unit has a terrace or balcony; Tripura still asks for one in towers above 60 m.
How often is an apartment fire NOC renewed?
- It depends on the state: 5 years in Delhi until 20 May 2027, Uttar Pradesh, Bihar and Odisha; 3 years for apartments of 18 m and above in Andhra Pradesh; generally yearly in Rajasthan. Maharashtra has no routine renewal: Form B every January and July instead.
