Fire NOC for a clinic: dental, diagnostic and day-care centres, state by state

Updated By Flamekite Editorial DeskFacts checked against official sources on

Quick answer

A clinic with no beds is a business building (E-2) in NBC 2016, so most states ask for a fire NOC only above 15 m or a 500 m² floor; UP and Sikkim at any size.

NBC 2016 names outpatient clinics and laboratories in Group E-2 and doctors' offices in E-1; only buildings where patients stay, such as hospitals and nursing homes, are Group C-1. So a consultation, dental or pathology clinic usually follows its state's business line: over 15 m or 5 storeys in Delhi, 12 m or 500 m² in Odisha and Chhattisgarh, over 1,000 m² or 15 m in Kerala. Add beds, an ICU or overnight stays and the lower institutional line applies, often 9 m. West Bengal lets clinics up to 15.5 m and 500 m² self-certify every year instead.

Getting a clinic's fire clearance in 8 steps

  1. Fix your occupancy before you sign the lease

No beds and no overnight stay usually means business (E-1 or E-2); recovery beds, day care with beds or inpatients mean institutional (C-1). In West Bengal a no-bed diagnostic centre is still C-1.

  2. Measure the whole building, not your floor

The line counts the building's height, storeys and floor area, mezzanine and stilt included in many states. A clinic on the first floor of a 16 m tower in Delhi is in a building over the business line.

  3. Read your state's row above

Find the business line for a no-bed clinic and the institutional line if you will keep beds, then check whether the landlord already holds a certificate for the building.

  4. Fit the Table 7 minimum for your band

At least extinguishers and a manual call point alarm; a hose reel and terrace tank once there are beds or the building passes ground plus 1. Keep CO2 extinguishers for the lab and electrical panel.

  5. File the route your state allows

Self-certification in West Bengal (Form-8 or Form-6 on edistrict), self-declaration in Kerala between 300 and 1,000 m², a licensed agency's fire plan for Puducherry Category B, or the full NOC application above the line.

  6. Register the clinic with the fire papers in the file

Submit the fire certificate, self-certification or undertaking your clinical establishment law or accreditation asks for with the registration or renewal.

  7. Train staff and drill

Train every staff member on the extinguishers and evacuation, and run a mock drill; NHSRC sets one each quarter for government primary facilities.

  8. Diary the renewal and re-check after any change

Renew before the term ends, file any yearly self-certification on time, and start again when you add beds, an ICU, a basement or a floor.

NABH's 2025 Delhi notice on dental clinics, labs and day care

NABH answered Delhi health providers' questions on 11 March 2025, on the basis of NBC 2016 Part 4. It is the only official text found that names dental clinics and diagnostic labs in a fire NOC rule.

Word for word

Day Care Establishments (e.g., Eye Centres, Dental Clinics, OPDs, Diagnostic Labs, Dialysis Centres): If these establishments do not provide sleeping or overnight facilities for patients, they fall under the category of Business Occupancy.

NABH notification NABH/Gen/2025/2203, 11 March 2025, point 1 NABH notice 2025

Point 1 lets such establishments run in buildings with a single basement below 200 m² and up to ground plus 3, below 15 m, with basement use subject to MCD or NDMC approval. Point 2: business buildings below 15 m or ground plus 3 are exempt from a Fire NOC; point 3: above 15 m they need one. Nursing homes and hospitals of 9 m or less need no certificate (point 4), but basements may never hold inpatients, operating theatres or a cath lab (point 6). Where no NOC applies, point 9 asks NABH applicants for a third-party fire audit to NBC Part IV, geo-tagged and time-stamped photographs, and an affidavit on the building's height and fire compliance.

NBCS 2026 clause 6.5.2 adds automatic fire detection for laboratories and outpatient clinics as business buildings. NBC 2016 is withdrawn and NBCS 2026 is voluntary, so a state applies these only as its own rules adopt them.

Minimum fire kit for a small clinic: 12 items from NHSRC and Form-8

Below every NOC line, these are what official documents ask a small health facility to keep. NHSRC wrote them for government primary facilities; West Bengal's Form-8 for clinics that self-certify.

  • Extinguishers of the right type at prominent places: ABC in OPDs, wards and circulation areas, CO2 in the laboratory and at electrical panels. NHSRC guidance note
  • Enough extinguishers for the floor: NHSRC gives one ABC extinguisher for each 100 m² as its example. NHSRC guidance note
  • Extinguishers mounted at least 4 inches off the floor and no higher than 5 ft, along the normal path of travel. NHSRC guidance note
  • A manually operated electric fire alarm with break-glass call points, the base of each call box at 5 ft. NHSRC guidance note
  • Illuminated or self-glowing exit signs, some at 1.2 to 1.5 m for patients, and exits never locked. NHSRC guidance note
  • An evacuation map marked "YOU ARE HERE" and the fire station's number at registration and the nursing station. NHSRC guidance note
  • Sand buckets to IS 2546 at exits and ramp landings. NHSRC guidance note
  • An electrical audit every year: loose wires, earthing, MCBs and ELCBs, load on power points. NHSRC guidance note
  • In West Bengal, extinguishers and a hose reel placed as IS 2190 and IS 3844 require, declared on Form-8. WB notification 1930
  • In West Bengal, an exclusive overhead fire tank of 10,000 litres up to 10 m, 15,000 litres above, with a 450 LPM terrace pump. WB notification 1930
  • No collapsible-gate lift doors, and an electrical safety audit by an Electrical Supervisor, both declared on Form-8. WB notification 1930
  • A landlord's NOC on file if you are the occupier, not the owner (Form-8's last line). WB notification 1930

Clinic registration laws that ask for fire papers

The Clinical Establishments Act, 2010 and its 2012 Central Rules say nothing about fire. The fire wording sits in the minimum standards and in a few states' own rules, and only Andhra Pradesh makes a fire certificate a plain condition of a clinic's registration.

Under the 2010 Act, which the national portal lists for 19 states and UTs, registration rests on section 12's minimum standards. Rule 9 of the Central Rules, 2012 adds rate display, treatment guidelines and records, and no fire item. The National Council's standard for a consultation-only clinic or polyclinic (CEA/Clinic-008) lists 1 fire extinguisher among its emergency equipment, and the short-stay clinic standard (CEA/Clinic-010) says an ABC type. The 2018 amendment rules for diagnostic and pathology labs ask for fire exit signage and at least 1 extinguisher, desirable for basic and medium labs and essential for advanced ones. A fire NOC appears only in the hospital standard's list of legal requirements, "all may not be applicable".

Karnataka's KPME Rules, as amended in March 2018, put a fire safety certificate on the Form A registration upload list and the Form B renewal list, for every category from consultation clinics to labs, with a footnote that the requirement for existing establishments would be notified separately. Ordinance 7 of 29 September 2025 made a Fire Safety Certificate under the Karnataka Fire Force Act a prerequisite for permanent registration; the Bill that replaced it, as passed, left that clause out. So the form asks for the certificate, while the Act, as Flamekite read it, does not.

Andhra Pradesh's G.O.Ms.No.148 of 3 December 2021 added a "Fire Safety Certificate from Fire Department" to what the registering authority must see before it registers a clinic, and a date-of-fire-NOC line to Form I. Kerala's 2023 standards rules list fire-fighting equipment, 1 unit, for clinics (Annexure 4), and an NOC from the Chief Fire Officer among the documents for imaging centres (Annexure 35, an indicative list). Gujarat's 2024 amendment asks every applicant to upload a fire NOC or certificate "as applicable". Tamil Nadu's 2018 rules set fire-fighting equipment for hospitals only, and Delhi's nursing-home checklist asks for a Delhi Fire Service NOC only where beds are on the second floor or above.

Eight faults that recur in the instruments read for this page, each with the instrument's own answer.

  • If Running a Delhi day-care centre or dental clinic in a basement without approval

NABH's 2025 notice makes basement use subject to MCD or NDMC approval; get it, and keep the basement under 200 m². NABH notice 2025

Questions about fire NOCs for clinics

Is a fire NOC required for a clinic?

Only once the building crosses your state's line. A clinic with no beds is a business building in NBC 2016, so the line is often 15 m or a 500 m² floor; Uttar Pradesh and Sikkim cover it at any size. Beds or an ICU bring the institutional line, often 9 m.

Does a dental clinic need a fire NOC?

Usually not in a low building. NABH's 2025 Delhi notice treats dental clinics with no overnight stay as business occupancy, exempt below 15 m. Uttar Pradesh still covers every business building, and West Bengal asks small clinics for a yearly Form-8 self-certification.

Is a clinic a business or an institutional building?

Without beds, business: NBC 2016 lists outpatient clinics and laboratories in E-2 and doctors' offices in E-1. With patients staying, such as recovery beds or a nursing home, it is C-1 institutional. West Bengal also files no-bed diagnostic centres under C-1.

How many fire extinguishers does a clinic need?

IS 2190 sets the number and position, as West Bengal's Form-8 says. NHSRC gives one ABC extinguisher for each 100 m² as its example for primary health facilities, with CO2 in the laboratory and at electrical panels.

Does a diagnostic centre with an X-ray need a separate fire clearance?

The AERB licence does not cover fire: the AERB code says it does not address fire safety. The fire line is the building's, under your state's rules; in West Bengal a no-bed diagnostic centre self-certifies only up to 6 m.

What does NABH ask from a clinic that needs no fire NOC?

In Delhi, a third-party fire safety audit to NBC Part IV, geo-tagged time-stamped photographs, an affidavit on the building's height and fire compliance, and for a day-care establishment, the basement-use approval from MCD or NDMC.

Do I need a fire NOC to register a clinic under KPME or the Clinical Establishments Act?

The 2010 Act and its 2012 Central Rules have no fire clause; the national clinic standard asks for 1 extinguisher. Karnataka's KPME forms list a fire safety certificate for upload, Andhra Pradesh requires one before registration since 2021, and Gujarat asks for one where applicable.

How long is a clinic's fire certificate valid?

It depends on the state: 2 years in Odisha and Nagaland, 3 years in Bihar, Delhi, Haryana and Manipur, 5 years in Goa and Lakshadweep. Uttar Pradesh gives business buildings 3 years and hospitals 1, and Assam's certificate lasts until cancelled.

What could Flamekite not confirm for clinics?

The official text of the MoHFW 2026 healthcare fire guidelines, a clinic line in Maharashtra, Tamil Nadu, Madhya Pradesh, Goa and Himachal Pradesh, NABH's 9 to 15 m nursing home case in the Delhi Rules, and the NBCS 2026 protection tables for clinics.
