Fire NOC for a nursing home: when beds and floors bring it in, and what it costs

Updated By Flamekite Editorial DeskFacts checked against official sources on

Quick answer

A nursing home is a hospital in the fire codes: subdivision C-1 of NBC 2016 and C-I of NBCS 2026 name hospitals, infirmaries, sanatoria and nursing homes together. Whether it needs a fire NOC turns on height, floors and beds: over 9 m or 3 storeys in Delhi, 9 m in Bihar, Haryana and Manipur, more than 30 beds in Chhattisgarh and Odisha, and any size in Uttar Pradesh, Andhra Pradesh and Assam.

The health registration often asks first. Delhi's Nursing Home Cell wants a Delhi Fire Service NOC once in-patient beds sit on the second floor or above, and a Rs 100 fire-safety affidavit below that. Rajasthan exempts only a ground plus one building with no beds on a plot up to 1,000 m², and NBC 2016 asks a ground plus 2 nursing home with beds for sprinklers, a wet riser and a 75,000 litre tank.

Getting a nursing home's fire NOC in 7 steps

  1. Record the building as C-1 and count census beds

A nursing home is C-1 (NBC 2016) or C-I (NBCS 2026), not a clinic or a home. Count the beds the way the health authority does: Delhi counts ICU, neonatal and ward beds, not pre-operative, dialysis or triage beds.

  2. Measure height, storeys, plot and floor area

Test the building against your state's row above: 9 m or ground plus 2 in Delhi and Bihar, 30 beds in Chhattisgarh and Odisha, a 1,000 m² plot in Rajasthan, any size in Uttar Pradesh.

  3. Read the health registration rule beside the fire law

Delhi's Category C, Mumbai's section 394 compliance and Chhatrapati Sambhajinagar's Fire NOC or Form B all sit in the registration file, so the fire papers often decide when the nursing home can open.

  4. Fit the systems for your floors and beds

Use the NBC 2016 Table 7 row that matches: a ground plus one nursing home with beds needs extinguishers, a hose reel, a manual alarm and a 5,000 litre terrace tank; ground plus 2 with beds adds a wet riser, sprinklers, detection and a 75,000 litre tank.

  5. File with drawings that mark beds, oxygen and exits

Mumbai's fire brigade asks for an architect's plan marking stairs, exits, the OT, the oxygen store and the switch board, with the occupant load and building height; Puducherry asks for bed details.

  6. Pass the inspection and keep the papers on site

The fire officer checks stairs, corridors, tanks and pumps; in Delhi the health inspector also ticks whether a valid fire safety clearance is on file.

  7. Renew on the hospital clock

Hospitals renew every year in Uttar Pradesh, Puducherry and Sikkim; Rajasthan uses 5, 3 or 1 year by size; Delhi's registration renews every third year before 31 January.

C-1, census beds and Category C: the words a nursing-home file turns on

The class a fire officer records and the beds a health inspector counts decide which line applies. These 9 terms come from the codes, the Delhi checklists, Maharashtra's Act and NABH.

C-1 Hospitals and sanatoria (NBC 2016)
A building under single management housing people with physical limitations from health or age, or incapable of self-preservation: hospitals, infirmaries, sanatoria and nursing homes. BIS, NBC 2016 Part 4
C-I (NBCS 2026)
The same class in the 2026 national standard, which also gives nursing homes their own protection row and an occupant load of 12.0 m² per person. BIS, SP 7:2026
C-2 Custodial institutions
Homes for the aged and infirm, convalescent homes and orphanages. An old-age home without nursing care sits here, not with nursing homes. BIS, NBC 2016 Part 4
Census bed (Delhi)
A bed counted for registration: ICU, neonatal and general ward beds. Pre-operative, post-operative, pre-natal, post-natal, dialysis and triage beds are not counted; day-care beds count only where no night stay is offered. DGHS checklist A-B
Category A, B and C (Delhi)
A: in-patient beds on ground and first floor only. B: no night stay after a procedure. C: in-patient beds on the second floor and above, which needs a Delhi Fire Service NOC. DGHS checklist C
Local supervising authority (Maharashtra)
The Health Officer of the Municipal Corporation, the Civil Surgeon in council areas, the Cantonment Health Officer, or the Zilla Parishad's District Health Officer. Mah. Act II of 2006
Self-certification (NBCS 2026)
For a nursing home up to 500 m² and up to 24 m, both conditions met, certification by a certified and state-approved building professional is treated as acceptable. BIS, SP 7:2026
Progressive horizontal evacuation
Moving patients sideways through a fire-resistant wall into the next compartment on the same floor; NBCS 2026 sizes each compartment to take the next one's patients at 3.5 m² a person. BIS, SP 7:2026
Fire Safety Compliance Certificate (NABH)
A third-party certificate after an in-depth fire audit, which NABH accepts for accreditation while a hospital shows it is still trying to get the fire NOC. It is not a NOC. NABH clarification

The Delhi High Court on nursing-home fire safety, 3 July 2024

Delhi's nursing homes argued that small buildings on mixed-use land are not institutional buildings. The court ordered inspections instead.

Word for word

the Court's immediate priority is to safeguard public safety and ensure that the basic fire safety equipment, as mandated by law, are installed at the premises of private nursing homes.

Order of 3 July 2024, Delhi Medical Association v. Government of NCT of Delhi, W.P.(C) 6952/2022, High Court of Delhi (Sanjeev Narula J.) Delhi High Court

Delhi Fire Service's note of 18 January 2023, filed in the case, set the floor for institutional buildings under 15 m: an access road of 9 m under the Master Plan or 7.5 m under the 2016 bye-laws, though "6.0 meter wide access road is acceptable for fire vehicles"; at least 2 staircases; stairs 2.0 m wide; corridors 2.4 m for hospitals and nursing homes. The court set up a joint committee of the health directorate, the fire service and DDA within 2 weeks, to report every non-compliance except structural defects within 4 weeks of inspection and suggest other remedies. A sub-committee formed on 27 November 2019 on the same question had still not reported.

Fire systems a nursing home needs by floors and beds: NBC 2016 Table 7

NBC 2016 splits hospitals, sanatoria and nursing homes under 15 m by floors and by whether there are beds, which no other occupancy does. These are the minimum installations, read off the page images.

Read from NBC 2016 Part 4 pages 43 and 44 as reproduced in Annexure A of Rajasthan's order of 14 September 2023, and checked against the Puducherry Fire Service copy. Every row needs extinguishers. Delhi's nursing-home sheet asks a ground plus 2 nursing home under 15 m for the same 75,000 to 1,50,000 litre tank and 1,620 l/min pumps. NBC 2016 was withdrawn on 30 April 2026; Rajasthan's order and Uttarakhand's fire service still apply this table.

Nursing-home registration laws that ask for the fire papers

In 4 states the health registration file, not only the fire Act, decides whether a nursing home must show a fire NOC. Each law asks in its own way.

Delhi's Nursing Homes Registration Act, 1953 and its Amendment Rules of 4 March 2011 set the registration: renewal every third year in Form B before 31 January, and a fee for 3 years of Rs 2,000 up to 10 beds, Rs 3,000 for 11 to 30 beds and Rs 3,000 plus Rs 100 a bed beyond 30. The 2011 Schedule itself has no fire clause. The fire test comes through the Nursing Home Cell's checklists: a Category A or B nursing home files an affidavit on Rs 100 stamp paper answering yes or no on 7 fire heads, from a valid fire and electrical audit to detectors, sprinklers and staff training, while a Category C nursing home must attach an architect's as-built plan and a NOC from Delhi Fire Service. The inspection form asks whether a valid fire safety clearance is held and, if not, whether in-patients are confined to the ground and first floors.

Maharashtra registers nursing homes under the Bombay Nursing Homes Registration Act, 1949, as amended in 2005: the local supervising authority is the municipal Health Officer or the district's Civil Surgeon or Health Officer, and a certificate runs to 31 March of the third year. The Maharashtra Fire Service's circular 64 of 31 January 2025 stops routine renewal of fire approvals but keeps it where another Act needs it, naming the Nursing Home Act. Chhatrapati Sambhajinagar's registration lists "Fire NOC/Form B" among the mandatory documents, and Mumbai's fire brigade runs a separate fire safety compliance for nursing homes under section 394 of the Mumbai Municipal Corporation Act, with a 7-item NOC list and a 12-item compliance list.

Karnataka briefly made the fire certificate part of the medical licence. The KPME (Amendment) Ordinance of 29 September 2025 listed "necessary Fire Safety Certificate confirming compliance with the Karnataka Fire Force Act, 1964" as clause (vi) of the prerequisites for permanent registration or renewal. Bill 87 of 2025, as passed by the Assembly with amendment, repeals the Ordinance and lists the prerequisites without it; registration now lasts 5 years, and a QCI or NABH certificate brings registration within 10 days. Flamekite did not find the Act's assent.

West Bengal's Directorate of Health Services told every district on 15 December 2011, six days after the AMRI fire, to "ensure Fire safety measures including Fire License in all Clinical Establishments", using improvement notices under section 23(1) of the 2010 Clinical Establishments Act with a reply in 14 days and prohibition or cancellation where patients face imminent danger.

Where nursing homes fail fire inspections, and the fix

Nursing-home failures are about patients who cannot walk out: beds above a single stair, oxygen in the corridor, a basement ward. These 8 come from the checklists, court orders and reported fires.

  • If In-patient beds on the second floor served by one staircase

Provide the second staircase the DFS sheet asks for, or keep in-patients on the ground and first floors. DFS

  • If More beds in use than the registration allows

Apply for an extension of bed strength first; the Vivek Vihar hospital ran 12 beds against 5 permitted. The Tribunenews report

  • If Treating a 9 m building as free of fire rules

Delhi's Category A affidavit still asks about detectors, alarms, sprinklers, hose reels and extinguishers. DGHS checklist A-B

  • If Oxygen cylinders standing loose in corridors and wards

Store them upright in a ventilated area away from combustibles, with filled and empty cylinders apart. DGHS checklist A-B

  • If DG set diesel kept beside the main switch board

Move the fuel; the Delhi affidavit asks this question directly. DGHS checklist A-B

  • If A ward, OT or cath lab in the basement

Move it above ground: NABH's Delhi notice bars basements for in-patients and theatres. NABH notice 2025

  • If A store room with no detection, next to living quarters

Fit detection in stores; the Dhanbad fire of January 2023 began in a store room at about 2 am. The Tribune (PTI)news report

  • If Stairs and corridors too narrow in an old building

Ask for the alternative measures the Delhi High Court's joint committee was told to suggest for structural defects. Delhi High Court

Questions about fire NOCs for nursing homes

Is a fire NOC mandatory for a nursing home?

It depends on the state, the floors and the beds. Delhi requires one over 9 m or 3 storeys, Chhattisgarh and Odisha above 30 beds, and Uttar Pradesh, Andhra Pradesh and Assam at any size. Rajasthan exempts only a ground plus one building with no beds on a plot up to 1,000 m².

Does a Delhi nursing home need a fire NOC for registration?

Yes if in-patient beds are on the second floor or above: the Category C checklist asks for a NOC from Delhi Fire Service and an architect's as-built plan. With beds on the ground and first floors only, the owner files a 7-head fire-safety affidavit on Rs 100 stamp paper instead.

What fire equipment does a small nursing home need?

Under NBC 2016, a ground plus one nursing home with beds needs extinguishers, a first-aid hose reel, a manual fire alarm and a 5,000 litre terrace tank with a 450 l/min pump. At ground plus 2 with beds it adds a wet riser, sprinklers, automatic detection and a 75,000 litre underground tank.

What is the fire NOC fee for a nursing home?

Punjab charges Rs 5,000 up to 30 beds, rising to Rs 1 lakh; Rajasthan Rs 2, 1.50 or 1 per sq ft; Assam Rs 1,000 to Rs 2,500 a stage; Meghalaya Rs 4 per m². Uttar Pradesh charges no portal fee, and Delhi's rules in force set no fire certificate fee.

Can a nursing home get NABH accreditation without a fire NOC?

Only for a time. NABH accepts a third-party Fire Safety Compliance Certificate after an in-depth fire audit, with no zero score on its fire elements, while the hospital shows it is still trying to get the NOC from the fire service.

How often must a nursing home renew its fire NOC?

Every year in Uttar Pradesh, Sikkim and for Puducherry hospitals; every 2 years under 15 m in Chhattisgarh; every 5, 3 or 1 year by size in Rajasthan. The MoHFW and NDMA advisory of 23 March 2024 asks hospitals to renew annually.

Does an old age home need the same fire NOC as a nursing home?

Not always. NBC 2016 puts homes for the aged and infirm in C-2 custodial institutions, with their own Table 7 rows, while nursing homes are C-1. Meghalaya charges homes for the aged Rs 3 per m² against Rs 4 for nursing homes.

What documents does Mumbai's fire brigade ask a nursing home for?

For fire safety compliance under section 394 of the MMC Act: the approved plan, occupation and registration certificates, an architect's plan marking stairs, exits, the OT and the oxygen store, an electrical audit, Form A and Form B from a licensed agency, and a Rs 500 indemnity bond.
