Model Fire Bill 2019: what the Ministry of Home Affairs' template says, section by section
Updated By Flamekite Editorial DeskFacts checked against official sources on
Quick answer
The Revised Model Bill to Provide for the Maintenance of Fire and Emergency Service for the State (2019) is a template that the Ministry of Home Affairs wrote for states to copy. It has 11 chapters and 69 sections. It binds nobody until a state legislature passes it, and fire is a state subject.
Its working core is Chapter V. Section 24 makes owners keep fire measures in order and asks buildings over 15 m, special occupancies and mixed use over 500 m² for a Fire Safety Certificate; section 25 sets a one-month issue time; section 26 and 32 make a Fire Safety Officer compulsory on pain of Rs 10 to Rs 50 per m² a month; sections 47 and 48 add a fire tax on property tax.

Model Fire Bill section 24: the numbers that decide who needs a certificate
Five figures carry most of the Bill's reach over private buildings. A state that copies them gets the same thresholds.
15 m
Height above which a multistoried building must obtain a Fire Safety Certificate (s.24(3)(i)) MHA, NDM India
500 m²
Area of a mixed occupancy that brings it in, when it includes a special occupancy (s.24(3)(iii)) MHA, NDM India
1 month
Time the Fire Officer has to issue the certificate from a complete application (s.25(i)) MHA, NDM India
2 a year
Maintenance certificates the owner files, in January and July (s.24(5)) MHA, NDM India
30 days
Notice period before the Fire Safety Officer levy starts (s.32(1)) MHA, NDM India
Model Fire Bill owner and occupier duties in sections 24 to 26
Read together, sections 24 to 26 give an owner six standing duties. The Bill makes them joint where owner and occupier are different people.
- Provide the minimum fire-fighting and life safety installations the bye-laws require, and keep them operational at all times (s.24(1)(i) and (ii)). MHA, NDM India
- Fit automatic sprinklers, fire alarms and extinguishers in the buildings that need a certificate, as the rules prescribe (s.24(4)). MHA, NDM India
- Hand the Fire Officer a qualified agency's compliance certificate, then a maintenance certificate every January and July (s.24(5)). MHA, NDM India
- Use only qualified agencies, as the National Building Code or the rules define them, to install or service the systems (s.24(6)). MHA, NDM India
- Never tamper with, alter or remove installed fire equipment, or get anyone else to (s.25(iv)). MHA, NDM India
- Appoint a Fire Safety Officer for premises the state names, send a compliance report, and refill the post at once on a vacancy (s.26(1) and (3)). MHA, NDM India
- Send the Fire Safety Officer to the state training institute unless trained at the National Fire Service College, Nagpur or an equivalent recognised body (s.26(5)). MHA, NDM India
Which buildings need a Fire Safety Certificate under Model Fire Bill section 24(3)
Section 24(3) names three groups, without prejudice to the state's own building bye-laws. A building in any one needs the certificate.
If The building is multistoried and more than 15 m high
It needs a Fire Safety Certificate from the Fire and Emergency Service (s.24(3)(i)). MHA, NDM India
If It is an educational, institutional, assembly, business, mercantile, industrial, storage or hazardous building as NBC 2016 defines it
It needs the certificate whatever its height (s.24(3)(ii)). MHA, NDM India
If It mixes occupancies and one of them is on the list above, with the whole over 500 m²
It needs the certificate (s.24(3)(iii)). MHA, NDM India
If It falls in none of the three
Section 24(1) still binds the owner to provide and maintain the bye-law measures, and the occupancy certificate cannot issue until he has (s.24(2)). No Fire Safety Certificate is asked for. MHA, NDM India
Model Fire Bill certificate route: from section 24(5) to appeal under section 44
The Bill's path runs from a qualified agency's report to a one-month decision, a twice-yearly upkeep filing, possible cancellation and a 30-day appeal.
1. Qualified agency certifies
The owner furnishes the agency's compliance certificate in the prescribed form (s.24(5)). The occupancy certificate cannot issue before compliance (s.24(2)). MHA, NDM India
2. Fire Officer scrutinises
On the owner's application with documents, designs, maps and completion certificates, the Fire Officer inquires and issues the certificate within a month (s.25(i)). MHA, NDM India
3. Owner files upkeep certificates
Twice a year, in January and July, certifying the measures are in good repair and efficient (s.24(5)). MHA, NDM India
4. Inspection and notice
The Director or Fire Officer may inspect on three hours' notice between sunrise and sunset, or at any time while an industry works or an entertainment is on, then issue a notice with a time limit (s.27). MHA, NDM India
5. Cancellation after hearing
If the owner ignores the Fire Officer's directions, the certificate is cancelled after a show-cause hearing, and the building cannot be occupied on that ground (s.25(ii) and (iii)). MHA, NDM India
6. Appeal
Within 30 days to an Appellate Authority at least two ranks above the Fire Officer, late with sufficient cause; the second appeal is final (s.2(a), s.44). MHA, NDM India
Powers the Model Fire Bill gives fire officers, sections 15 to 27 and 57
The Bill gives the service nine working powers over people and property. State Acts that copy it usually keep the same list.
- Section 15: at a fire
- The officer in charge may remove interferers, close streets, break into or pull down premises (with reasonable compensation), order water mains regulated, disperse crowds as a police station officer would, and arrest a wilful obstructor. MHA, NDM India
- Section 16: water
- Draw water from any source in the area; its controller supplies it at prescribed rates. MHA, NDM India
- Section 21: precautions
- The state may notify precautions for premises likely to cause a fire risk; the officer may then remove dangerous goods to safety, or seize them after hearing the owner. MHA, NDM India
- Section 23: encroachments
- Goods or encroachments that block fire-fighting go to the Sub-Divisional Magistrate, who may order seizure and, if unclaimed, public sale. The Director may order removal at once where the risk is imminent. MHA, NDM India
- Section 22: pandals
- The erector signs a prominent declaration of the measures taken; the officer may inspect and seal the pandal if directions are not met in time. MHA, NDM India
- Section 27: inspection
- Entry on three hours' notice in daylight, any time for working industries and entertainments; due regard to the social and religious sentiments of occupiers. MHA, NDM India
- Section 56 to 57: information and sealing
- The Director may obtain information, and where a building is dangerous to life may order everyone out, have police remove them and seal it. Breaking a seal costs up to 3 months, ₹25,000 or both. MHA, NDM India
- Section 40: compounding
- Offences under sections 32 to 38 may be compounded for the amount the state notifies, but not while a notice, order or requisition remains unmet. MHA, NDM India
Model Fire Bill offences and penalties, sections 30 to 40
The ladder is short and low in rupees. The one open-ended charge is the Fire Safety Officer levy, which scales with floor area.
| Offence | Penalty | Law |
|---|---|---|
| Breaching the water supply chapter | Up to 6 months, or a fine up to ₹50,000, or both; ₹3,000 a day after the first for a continuing offence | Section 30 MHA, NDM India |
| Not appointing a Fire Safety Officer within 30 days of a notice | ₹10 to ₹50 per m² of area owned or occupied, common areas included, for each month or part; recovered as land revenue | Section 32 MHA, NDM India |
| Not following a precaution notification or direction under section 21 | Up to 3 months, or a fine up to ₹10,000, or both; ₹1,000 a day if continuing | Section 35 MHA, NDM India |
| Wilfully obstructing fire-fighting or rescue | Up to 3 months, or a fine up to ₹10,000, or both | Section 36 MHA, NDM India |
| A knowingly false report of a fire | Up to 3 months, or a fine up to ₹10,000, or both | Section 37 MHA, NDM India |
| Any other breach of the Act, rules or a notification | Up to 3 months, or a fine up to ₹10,000, or both; ₹1,000 a day if continuing | Section 38 MHA, NDM India |
| Breaking a seal on a building | Up to 3 months, or a fine up to ₹25,000, or both | Section 57(5) MHA, NDM India |
| Failing to pass on information about a fire | Treated as an offence under the first part of section 176 of the Indian Penal Code, 1860, as the Bill is worded | Section 34 MHA, NDM India |
| An offence by a company | Every person in charge, and any director or manager whose consent or neglect is proved, is guilty, unless he shows lack of knowledge or due diligence | Section 39 MHA, NDM India |
Section 29 leaves the penalties for breaches of the other sections to the state's rules. A court below a Sub-Divisional Judicial Magistrate cannot try an offence (s.43), and only the Director or an officer he authorises can start a prosecution (s.42).
Model Fire Bill fire tax, fees and fund, sections 47 to 51
The Bill pays for the service with a surcharge, not a new tax base: the property tax authority collects it.
As published
- Fire tax on lands and buildingsA notified % of property taxSection 47(2); the state sets the percentage by Gazette. No fee on buildings owned or held by the government or a public authority (s.47(3)). MHA, NDM India
- CollectionCost deducted firstSection 48: the property tax authority assesses and collects as for property tax; a share is kept for cost, the rest goes to the state. MHA, NDM India
- Crews sent beyond state limitsAs the state prescribesSection 49: payable within 1 month of a demand, then recoverable as land revenue. MHA, NDM India
- Fire Prevention and Life Safety FundFees, tax and penaltiesSection 51: credited first to the Consolidated Fund, then transferred. Fines are excluded. Used for community preparedness, training and equipment. MHA, NDM India
- Where states set a rate1% of house tax in Uttar PradeshRule 72 of the UP Rules 2024. Haryana's section 39 rate notification was not found. UP Rules 2024
The Bill sets no rate. Whether any other state has notified one is not confirmed here.
Model Fire Force Bill 1958 versus the 2019 Model Bill
The 1958 Bill was the first template for state fire Acts. Its text could not be opened for this page, so the comparison is limited to what is documented.
DGFS still lists the Model Fire Force Bill of 1958 beside the 2019 Bill as its two model laws. The 1958 file sits on the DGFS site, whose TLS certificate had expired on 26 October 2026; Flamekite did not bypass the error and found no other official copy.
So no 1958 section number or penalty is quoted here. What can be said of the 2019 Bill is that it is written for a unified state service, ties duties to the National Building Code and the 2016 Model Building Bye-laws, and adds a certificate, a Fire Safety Officer and a fire tax, none of which is claimed for 1958.
| What | The rule | Source |

| Years apart | 61 years from 1958 to 2019 | DGFS, MHA |
| 2019 structure | 11 chapters, 69 sections | MHA, NDM India |

Drafting slips and gaps inside the Model Fire Bill text
The MHA copy has at least five cross-reference errors. A state copying it word for word can carry them into its Act.
If Section 2(a) says the Appellate Authority is two ranks above the Fire Officer 'as defined in Section 45', but section 45 is the training institute
Read it as the Fire Officer of section 8. Check that your state's Act corrected the reference. MHA, NDM India
If Section 22(4) makes a false pandal declaration an offence 'under Section 40', but section 40 is compounding
The penalty must come from section 38 or the state's own section; read the Act, not the model. MHA, NDM India
If Section 25(ii) cancels a certificate 'issued under Section 24', but section 25 issues it
The cancellation power is the same; only the citation is off. MHA, NDM India
If Section 30 is headed as penalties for the water supply chapter (IV) in the body but the contents list says Chapter V
The body governs: up to 6 months or ₹50,000 for water-supply breaches. Chapter V breaches fall under sections 35 and 38. MHA, NDM India
If Section 34 cites the Indian Penal Code, 1860
A state enacting today must update the citation; the Bill text was not revised for later criminal-code changes. MHA, NDM India
If Section 29 says penalties for the other sections are 'prescribed in the Rules'
The Bill alone does not fix them; the state's rules do. MHA, NDM India

Model Fire Bill section 24 worked on three buildings
Flamekite’s working from the official rules; no government publishes this figure.
Flamekite's own reading of the Bill's text, not a state's law: it shows what a state copying section 24(3) would ask.
Case 1
A 12 m school
Four-storey educational building, 12 m high, 900 m².
What applies Needs a certificate. It is below 15 m but educational buildings are named in s.24(3)(ii), so height does not matter. MHA, NDM India
Case 2
A 16 m apartment block
Residential, 5 storeys, 16 m high.
What applies Multistoried and over 15 m, so s.24(3)(i) applies. Qualified agency report, certificate in a month, January and July filings. MHA, NDM India
Case 3
A 9 m shop-and-flats building
Ground-floor shops, flats above, 9 m, 450 m².
What applies Mixed use but under 500 m² and under 15 m, so s.24(3)(iii) does not bite on area; whether the shop floor is 'mercantile' under NBC 2016 is a state-rule question. Section 24(1) duties still apply. MHA, NDM India

Questions about the Model Fire Bill 2019
What is the Model Fire Bill 2019?
- It is the Ministry of Home Affairs' Revised Model Bill to Provide for the Maintenance of Fire and Emergency Service for the State: 11 chapters and 69 sections that a state can enact as its fire law. It has no force until a state legislature passes it.
Is the Model Fire Bill 2019 in force?
- Not as a central law. Fire is a state subject, so only a state's own Act counts. Haryana, Uttar Pradesh, Nagaland, Arunachal Pradesh, Manipur, Lakshadweep and Dadra and Nagar Haveli and Daman and Diu have instruments that follow its pattern.
Where can I download the Model Fire Bill PDF?
- The MHA National Disaster Management Division hosts a 32-page copy at ndmindia.mha.gov.in; the DGFS site also lists it, though its security certificate had expired on 26 October 2026.
Which buildings need a fire safety certificate under the Model Bill?
- Multistoried buildings over 15 m, educational, institutional, assembly, business, mercantile, industrial, storage and hazardous buildings as NBC 2016 defines them, and mixed occupancies over 500 m² (section 24(3)).
How long does the Model Bill give to issue the certificate?
- One month from a complete application with documents, designs, maps and completion certificates (section 25(i)).
What is the fire tax in the Model Fire Bill?
- A surcharge on property tax at a percentage the state notifies, collected by the property tax authority (sections 47 and 48). Government-owned buildings are exempt. Uttar Pradesh's rule 72 sets 1% of house tax.
What is the penalty for no Fire Safety Officer?
- After a 30-day notice, ₹10 to ₹50 per m² of area owned or occupied for each month of default, recovered as land revenue (section 32).
How does the 2019 Bill differ from 1958?
- The 2019 text is confirmed here; the 1958 text could not be opened, so no section-level comparison is made.
